PART A KEITH HO TRADING AS BETXCHANGE (HEREINAFTER REFERRED TO AS “BETXCHANGE”) GENERAL INFORMATION CONCERNING ITS INTERNET BETTING SITE AND THE CONDUCT OF INTERNET BETTING TRANSACTIONS

1. COPYRIGHT

1.1. BetXchange has caused to have the contents of this Part A and Parts B, C and D devised and created by legal counsel and it has thereby expended considerable time and financial resources in doing so.

1.2. By virtue of the recordal in 1.1, the contents of this Part A and Parts B, C and D and more particularly the text, the layout and general format constitutes the lawful intellectual property of BetXchange. Accordingly, Parts A, B C and D constitute work of a copyright nature which vest in BetXchange and accordingly may not be infringed through copying (outright and/or partially) by any other party. In the event of infringement of its intellectual property rights then BetXchange will be entitled to take legal steps to prohibit the continuation of such copyright infringement and to lodge the relevant criminal complaint (for prosecution proceedings to be initiated), always subject to their right to claim whatever damages that BetXchange is entitled to claim in law.

2. ABOUT BETXCHANGE AND ITS INTERNET BETTING SITE

2.1. BetXchange is a proprietorship owned by Keith Ho, a citizen of the Republic of South Africa. Keith Ho t/a BetXchange has operated as a licensed bookmaker since 1988 and has strived to conduct himself in an honest and fair manner and more particularly has complied with all his obligations and more particularly the obligations imposed by the Gauteng Gambling Act No 4 of 1995 (“the Gambling Act”).

2.2. BetXchange has been issued with a bookmaker’s licence by the Gauteng Gambling Board, (an authority which regulates and controls gambling in the geographical area of Gauteng in South Africa) (its contact details are indicated in paragraph 12.2.) which entitles it to transact betting transactions with members of the general public, such licence having been issued in terms of the provisions of section 54 read with section 32 of the Gambling Act. The Gambling Act, and more particularly in terms of section 37, entitles the Gauteng Gambling Board to suspend and/or revoke BetXchange’s bookmaker’s licence if it does not conduct itself and its business in a fit and proper manner.

2.3. The National Gambling Board of South Africa and the Gauteng Gambling Board has consented to BetXchange transacting betting transactions via the internet, which is possible as a result of the utilisation of an electronic agent in the nature of a computer software programme (which has been tested and approved by the South African Bureau of Standards) which in turn gives rise to the creation of an automated betting transaction and thus a legally binding contract (confirmation hereof is to be obtained from www.ngb.org.za or info@ngb.org.za).

2.4. The means by which betting transactions are created is through an electronic agent and more particularly a computer software programme. The computer software programme, through the medium of the internet and the website created by BetXchange, enables BetXchange to convey to its customers the existence of various sporting events on which various types of betting odds are offered by it. Although BetXchange will make every effort to ensure that the computer software programme is functioning to its optimum, and more particularly efficiently and correctly, this unfortunately can never be guaranteed. Furthermore, although BetXchange will make every effort to ensure that errors do not take place, the information in the nature of betting odds, and/or participants and/or dates and times of sporting events, and/or the amount available to be won on a specific betting transaction may for example be incorrectly “typed in” and thereby captured onto the website i.e. as a consequence of human error. When this occurs BetXchange will have the right at any time to amend and/or void any betting transactions which then arise and as a consequence of the error. Accordingly, and whenever it appears to a customer that an error exists (as a result of the obvious failure of the computer software programme and/or as a result of obvious human error), then the customer should immediately telephonically communicate with BetXchange so as to draw attention to the error and thereby to avoid disappointment.

2.5. BetXchange is a member of the Gauteng Off Course Bookmakers’ Association, (commonly known as “GOBA”) (its contact details are indicated in paragraph 12.1) which association has as its members all licensed bookmakers in the geographical area known as Gauteng in South Africa. BetXchange is bound by the GOBA Constitution and more particularly has undertaken to conduct itself professionally, honestly and with integrity.

2.6. BetXchange’s contact details are as follows:-

2.7. BetXchange’s liabilities and more particularly its financial ability to pay successful betting transactions are guaranteed as a result of it, through GOBA, having issued to the Gauteng Gambling Board guarantees (supported by cash resources) in terms of the provisions of section 32 (1) (b) of the Gambling Act.

2.8. BetXchange supports responsible gaming. BetXchange urges its customers not to engage in betting transactions with it who financially cannot afford to indulge in betting transactions. Accordingly BetXchange invites its customers who have gambling problems and/or addictions to make use of the toll free contact number and being 0800 006 008 (South African contact number).

3. APPLICABLE LEGISLATION GOVERNING BETTING TRANSACTIONS WITH BETXCHANGE AND THE TERMS AND CONDITIONS WHICH WILL REGULATE THE RELATIONSHIP BETWEEN BETXCHANGE AND THE CUSTOMER

3.1. The opening of an internet betting account and more particularly the conduct of betting transactions between BetXchange and its customers shall be exclusively governed by the Laws of the Republic of South Africa.

3.2. The Laws of the Republic of South Africa recorded in 3.1 are the following:-

3.2.1. the National Gambling Act No 33 of 1996 read with its regulations (as amended from time to time); and

3.2.2. the Gauteng Gambling Act No 4 of 1995 read with its regulations (as amended from time to time); and

3.2.3. the Financial Intelligence Center Act No. 38 of 2001 read with its regulations (as amended from time to time) (“FICA”); and

3.2.4. the Electronic Communications and Transactions Act No 25 of 2002 read with its regulations (as amended from time to time); and 3.3. Should any potential customer and/or existing customer of BetXchange not accept all of its trading terms and conditions then such customer should not make application for the conduct of an account and/or should close their account.

3.4. The terms and conditions in Parts B, C and D shall be the only terms and conditions which regulate betting transactions between BetXchange and its customers, which terms and conditions BetXchange reserves to itself to amend, alter, vary and/or cancel, which amendment, alteration, variation and/or cancellation will, from time to time, be posted on its home page (being the primary entry point web page of BetXchange’s website).

3.5. Certain countries prohibit their citizens from transacting betting transactions within internet betting providers such as BetXchange. It is accordingly the obligation of any potential customer of BetXchange to make their own inquiries with their relevant local authorities to establish whether they are permitted to transact betting transactions with BetXchange through its internet website.

4. AGE RESTRICTION

In terms of section 78 of the Gambling Act, no person under the age of 18 (eighteen) shall be permitted to conduct betting transactions with BetXchange. In the event that BetXchange ascertains that a customer is under the age of 18 years, then BetXchange shall immediately cancel the customer’s internet betting account, and in its discretion shall be entitled to cancel all previous betting transactions and, where applicable, shall pay any credit amount in the internet betting account of the customer to the Gambling Board.

5. OPENING AND CONDUCTING OF AN INTERNET BETTING ACCOUNT WITH BETXCHANGE

5.1. In order to conduct betting transactions with BetXchange, it is necessary for the customer to provide all of the information sought in the account opening form which information the customer warrants is true and correct.

5.2. In terms of the provisions of the Financial Intelligence Center Act of 2001 it will be necessary for the customer to furnish BetXchange with a copy of the customer’s identity details (from an identity document/passport which must be valid) and proof of residence in the nature of a statement/invoice of account (rendered by a City Council or a bank in the case of mortgaged property) (which statements shall not be older than 3 (three) months). Should you have failed to comply with the provisions of FICA then BetXchange shall be prohibited from paying any credit balance in your account to you.

5.3. At all times the customer must ensure that its details in the opening account form remains up to date and to change any details that have altered since the date when the account was opened.

5.4. The opening and the conduct of an internet betting account will result in the issuing of a password and user name (which name must at all times be retained by the customer in a manner to ensure that no other third party has access to the customer’s account i.e. should the customer not adhere to this confidentiality request, BetXchange will not be liable for any unauthorised activity relative to the customer’s account).

5.5. The customer shall not be entitled and undertakes not to conduct, (through another person as agent or otherwise), additional internet betting accounts and should BetXchange determine that the customer is doing so, it shall have the right to immediately terminate the accounts and to void and cancel all successful betting transactions since inception of one or all of the accounts concerned.

5.6. Any credit balances in the customer’s account will be paid by BetXchange only in South African Rands (ZAR).

5.7. Any credit balances in the customer’s account will only be paid into the customer’s banking account (in the case of funds being paid into BetXchange’s banking account by way of an internet banking transfer) or into the customer’s credit card (in the case of funds being paid into BetXchange’s banking account by way of a credit card payment) or in cash to the customer himself.

5.8. Any request by a customer to withdraw credit amounts from an internet betting account must be in writing and the written request form of BetXchange must be completed and signed and thereafter telefaxed to BetXchange (it is suggested that after the telefaxing of the written request, the customer should communicate with our offices by way of telephone/email to confirm receipt of the written request). As regards the request for payment of credit amounts by a customer BetXchange will endeavor to process such request within 48 (forty eight) hours of receipt of such request – BetXchange will effect payment through the banking internet system but cannot warrant that such system will result in the credit transfer amount being reflected in the bank account concerned and within a specific time i.e. should there be a delay in the transfer of the credit amount, BetXchange will not be liable to the customer for any damages/losses from whatsoever cause arising.

5.9. Any credit balances in the customer’s internet betting account will not accrue any interest.

5.10. Should the customer effect payment of an amount into an account in the form of a cheque, the extent thereof will only be credited to the customer’s account after the cheque has been cleared. 5.11. BetXchange shall not accept any offers by its customers to transact betting transactions with it through the medium of telefaxes and/or emails and/or short message services.

6. BETTING TAX

Most successful betting transactions are not subject to a betting tax save that betting tax equal to 6 (six) per cent shall apply to the winning amount in regard to all horse racing events and any multiple bets which combine a horse racing event with other sporting events.

7. DEPOSITS INTO BETXCHANGE’S BANKING ACCOUNTS AND CREDITING OF THE CUSTOMER’S ACCOUNT

7.1. Deposits into the customer’s internet betting account may be effected, into BetXchange’s banking accounts detailed in 7.3, either in cash, cheque or by way of an electronic funds transfer utilising a bank account, credit card or debit account. All deposits must reflect the customer’s internet betting account. Should the customer fail to indicate its reference (being the relevant internet betting account number and/or reflect an incorrect internet betting account number or an internet betting account number which is illegible/cannot reasonably be determined) then BetXchange shall deposit the amount into a general holding account (in such event, BetXchange shall not be liable for any damages that the customer may suffer as a result of this fact).

7.2. The customer undertakes, once any deposit has been effected, to telefax and/or email proof of payment to BetXchange. BetXchange shall credit the amount deposited as soon as reasonably possible after receipt of the proof of the deposit payment and in the case of a cheque payment on the clearance thereof.

8. BETTING TRANSACTIONS GENERALLY SUBJECT TO THE STANDARD TRADING TERMS AND CONDITIONS OF BETXCHANGE

8.1. All betting transactions between BetXchange and the customer shall be subject to BetXchange’s standard trading terms and conditions which are to be located in Parts B, C and D (which terms and conditions may be altered, added to and/or varied from time to time by BetXchange, which alterations, additions and/or variations will be posted on its home page from time to time) subject to specific rules relative to specific sporting events which are to be located in Part C and the betting limits which are to be located in Part D.

CONCLUSION OF BETTING TRANSACTION

8.2. Each time the customer makes an offer to conclude a specific betting transaction with BetXchange, the offer by the customer will be on the condition that the standard trading terms and conditions of BetXchange at that time shall be applicable and the acceptance of the offer by BetXchange shall likewise be subject to BetXchange’s standard trading terms and conditions.

8.3. The conclusion of a successful betting transaction shall only be evidenced by the computer system and more particularly the computer software programme of BetXchange capturing the betting transaction. Once this has occurred, the customer cannot cancel and/or vary same in any manner whatsoever. All successful betting transactions may be viewed by the customer under the heading “Pending Bets” and the customer is urged to view same in order to confirm the status of its betting transactions. (Note that although a successful betting transaction may be confirmed, this does not mean that BetXchange will be thereafter precluded from voiding/or amending the betting transaction as a consequence of any breach of its standard trading terms and conditions and/or any mistake by BetXchange of whatsoever nature that has taken place and/or as a consequence of any malfunction of BetXchange’s computer hardware and/or software programme).

TELEPHONIC TRANSACTIONS

8.4. Although BetXchange does not encourage its internet customers to transact betting transactions with it via the medium of a telephone, the internet customer agrees that should BetXchange, in its sole and unfettered discretion, agree to transact a telephonic betting transaction with the customer then in such event its standard terms and conditions as indicated in Part B and Parts C and D shall apply to the betting transaction.

UNLAWFUL USE OF AN INCORRECT CREDIT AMOUNT

8.5. A customer shall on no account utilise any credit amount that has been incorrectly credited to his internet betting account e.g. the amount credited is R2000.00 whereas it should be R200.00 or where an amount is credited to the incorrect customer’s internet betting account. In the event that a customer utilises an incorrect credit amount in his internet betting account which does not accrue to him, BetXchange shall be entitled to void all and/or any betting transactions and to claim from the customer all amounts wagered (relative to unsuccessful betting transactions concerning the use of incorrect amount credited to the relevant internet betting account).

VOIDING / CANCELLATION AND/OR REPLACEMENT / ALTERATION OF BETTING TRANSACTIONS

8.6. BetXchange shall be entitled at any time to void / cancel betting transactions under the following circumstances:-

8.6.1. the sporting event concerned has commenced (this shall not apply to “in running” sporting events) and/or has been completed and/or does not commence within 48 (forty eight) hours of the advertised time of commencement; and/or

8.6.2. the failure/inability by BetXchange’s internet server to suspend betting and thereby ensuring that the software computer system does not accept the offers of customers and during the period that betting should have been suspended, betting transaction take place - for example where the internet server cannot be accessed by an employee of BetXchange as a result of the “freezing” of the system and/or the satellite “feed” malfunctioning in any respect, BetXchange’s intention to suspend betting in order to change the betting odds as a consequence of the happening of an event e.g. a goal having been scored, a try having been scored, a wicket having fallen; and/or

8.6.3. the malfunctioning of the computer system (software and/or hardware) which results in the incorrect reflection of betting odds.

8.7. BetXchange shall be entitled at any time to alter/vary any betting transaction where the incorrect betting odds have been reflected on its website due to human and/or software and/or hardware error/s.

9. BETTING TRANSACTION WIN LIMITS

9.1. By setting betting transaction limits (the maximum amount that can be won on any betting transaction whether it be a single bet or a multiple bet), BetXchange seeks to regulate and control its financial exposure as regards specific sporting events and/or specific bet types.

9.2. The customer’s attention is drawn to the fact that it is possible that the computer software programme may possibly fail and may permit betting limits to be exceeded i.e. for example, if a horse racing betting limit is R10 000.00 but BetXchange’s computer software programme permits a customer to take a bet to win R30 000.00 i.e. an excess of R20 000.00 over the permitted betting limit, then BetXchange shall be entitled, in its sole discretion, whether before, during or after the sporting event has taken place, to void the bet as regards the amount which exceeds the prescribed limit i.e. to replace the betting transaction with one that equals the limit amount that has been set and to adjust the amount staked.

9.3. In the event that a customer transacts a number of individual betting transactions which either constitute the same betting transactions and/or similar ones then these will be treated by BetXchange (at any time either before, during and/or after any one or more of the sporting events has occurred) as constituting one combined betting transaction. In the event, and as a result of the combining of the betting transactions, it should transpire that the maximum payout limit amount is exceeded, then BetXchange shall be entitled to adjust the betting transaction (combined) to bring same within the maximum payout limit (if necessary, BetXchange shall be entitled to void all betting transactions and to replace same with a single betting transaction)

9.4. The limits i.e. the maximum amount that a customer can win on any one betting transaction are those as indicated in Part D.

9.5. Although the maximum win limit amounts indicated in Part D limit the amount that a customer may win BetXchange, it its sole and unfettered discretion, shall be entitled to limit a customer’s win limit amount. In the event that where a customer’s win limit amount is fixed and this win limit amount is exceeded (due to human error and/or the malfunction of the computer hardware and/or the electronic software programme) BetXchange shall be entitled to adjust the betting transaction concerned, at any time, and in order to bring the betting transaction win limit amount within the customer’s maximum win limit amount parameter.

10. MULTIPLE BETTING TRANSACTIONS

10.1. The customer shall be entitled to conclude a betting transaction which is multiple in nature and more particularly which involves the outcome of one or more sporting events which if successful results in the gross amount (the winnings and the amount staked) being carried forward to the sporting event that occurs next in time and date (commonly known as “all to comes”).

10.2. Subject to 10.5 the customer shall be prohibited from transacting multiple betting transaction/s (“all to comes”) where the outcome of one part of the betting transaction contributes to the outcome of another part of the betting transaction. An example of a prohibited multiple bet would be the Crusaders to win the rugby game “all to come” the Crusaders to win the rugby game by 1 point. A further example of a prohibitive multiple bet would be the Crusaders to win the rugby game “all to come” the total points of the game to exceed 20 points.

10.3. The prohibition as regards “all to come” betting transaction/s shall also extend to transactions where it involves the same teams and/ in the same tournament - for example a prohibitive multiple bet would be Manchester United to win the first round of the FA Cup and it to win the FA Cup.

10.4. In the event that the Electronic Agent should permit a prohibited multiple bet Transaction as indicated in 10.2 and/or 10.3 for any reason whatsoever, then BetXchange shall settle the bet by equally dividing the stake unit where related outcomes clash.

10.5. The prohibitions recorded in 10.2 and 10.3 shall not apply as regards sporting events which physically take place in North America. In this regard the customer will be able to transact certain multiple betting transactions in the same sporting event e.g. team A to win by more than 10 points and the total points of the game to exceed 20 points.

11. WORD OF WARNING

11.1. BetXchange draws specific attention to the fact that during the course of betting transactions between it and the customer, it is possible (BetXchange will obviously take all possible steps to prevent this occurring) that errors and/or omission may arise i.e. errors due to the failure of its computer hardware and/or software and/or due to human errors. By way of example, these include the failure by the computer system to reject/not permit certain betting transactions which are prohibited (multiple bets in the same event) or betting transactions which exceed limit impositions or the reflection of incorrect betting odds (due to miss typing). In all these events, BetXchange shall be entitled to correct all errors and/or omissions and more particularly to cancel a betting transaction/s i.e. either before the sporting event concerned takes place, or during or thereafter (BetXchange will endeavour to communicate with the customer in regard to any correction / cancellation that it effects and to the customer’s email address, the failure by the customer to receive such email advice shall not entitle the customer to contend for the existence of a valid and binding betting transaction contract).

11.2. If the customer should realise that BetXchange’s computer software programme / and/or hardware and/or its employees/agents may have made an error in accepting a betting transaction (which should not have taken place), then the customer is urged to communicate with BetXchange to determine whether in fact an error has taken place and thereby to avoid the disappointment afterwards in being advised that the betting transaction concerned has been cancelled by BetXchange.

11.3. The importance of this warning is to be borne out of a recent decision by the Gauteng Gambling Board (in a matter concerning BetXchange and three punters) which declared that the acceptance by BetXchange of betting offers, (and the subsequent issuing of confirmations), which betting transactions were prohibited by BetXchange’s terms and conditions (multiple all to come bets in the same rugby sporting event) could be voided and cancelled by BetXchange even though the sporting events concerned had already taken place.

12. WINNING TICKET CLAIMS

12.1. Winning Ticket Claim Period – Winning Tickets must be claimed no later than 23h00 on the 1095th day after the winning results date of the particular game or draw. Any such winning tickets not claimed within this period will be forfeited.

TERMS AND CONDITIONS OF KEITH HO TRADING AS BETXCHANGE (HEREIN AFTER REFERRED TO AS “BETXCHANGE) WHICH WILL REGULATE BETTING TRANSACTIONS TRANSACTED BY HIS CUSTOMERS THROUGH THE MEDIUM OF THE INTERNET 

1.  INTRODUCTION

1.1.The terms and conditions which follow have been drafted in order to protect the interests of BetXchange and its customers who transact Transactions with it through the medium of the Internet and as a consequence of the customers establishing accounts with BetXchange.

1.2. Should any potential customer and/or existing customer of BetXchange not accept and/or understand all of its trading terms and conditions then such customer should not make application  for the conduct of an account and/or  should close their account and should not conclude electronic betting transactions with BetXchange through the medium of the Internet.

1.3. The terms and conditions that follow in this Part B read with the contents of Parts C and D (which follow)  shall be the only terms and conditions which regulate betting transactions between BetXchange and its customers, which terms and conditions BetXchange reserves to itself at any time to amend, alter, vary and/or cancel, which amendment, alteration, variation and/or cancellation will, from time to time, be posted on its home page (being the primary entry point web page of BetXchange’s web site).

2.    DEFINITIONS

In these terms and conditions:-

2.1. the headings to the clauses are for the purpose of convenience and reference only and shall not aid in the interpretation of or modify the provisions of these terms and condition; and

2.2. words importing any one gender shall include the other two genders, words in the singular shall include the plural and vice versa and, unless the context clearly otherwise indicates, the  following expressions shall have the following meanings respectively and cognate expressions shall bear corresponding meanings –

2.2.1. “ACCOUNT” means the specific account (with an account number) number designated  by BetXchange to You , which account will serve to record all Internet Transactions between BetXchange and You including Transactions which are unilaterally cancelled and/or amended by BetXchange in terms of these terms and conditions) ; and

2.2.2. “BETXCHANGE” means the trading name of its sole proprietor and being Keith Ho an adult male bookmaker; and

2.2.3. “COMPUTER SYSTEM” means collectively the computer software programme and the computer hardware that BetXchange utilises in order to enable it to permit the conclusion of Transactions with its customers and to enable it to relay information from its main frame computer server via the internet to its individual computer systems (including sporting events, participants in sporting events, betting odds and Transaction betting  win limit imposition amounts and/or sporting event results); and

2.2.4. “ELECTRONIC ACT” means the Electronic Communications and Transactions Act no 25 of 2002; and

2.2.5.“ELECTRONIC AGENT” means the computer programme that BetXchange utilises in order to enable it to permit the conclusion of Transactions with its customers and which will constitute an automated transaction (as defined in the Electronic Act); and

2.2.6.“GAMBLING ACT” means the Gauteng Gambling Act no 4 of 1995; and

2.2.7. “GAMBLING BOARD” means the Gauteng Gambling Board, a juristic person established in terms of section 3 of the Gambling Act; and

2.2.8. “GOBA” means the Gauteng Off Course Bookmaker’s Association, an Association of persons who constitute persons who are licensed bookmaker’s and who operate in the geographical area known as Gauteng and in South Africa; and

2.2.9. “INTERNET” means the interconnected system of networks that connects computers around the world using the TCP/IT (Transmission Control Protocol Internet Protocol used by and information system to connect to the Internet and includes future versions thereof);

2.2.10. “LAW” means the laws of the Republic of South Africa including, if applicable, the Gambling Act and/or the Electronic Act; and

2.2.11.“TRANSACTION/S”  means the electronic betting  Transaction/s transacted between You and BetXchange through the medium of the Internet and arising from contacts between You and the website; and

2.2.12.“YOU” and/or “YOUR” means You the customer/the client of BetXchange.

2.2.13. “WEBSITE” means the location on the Internet containing the home/web page of BetXchange and being the primary entry point of the website of BetXchange.

3.    PROHIBITION AGAINST UNDERAGE GAMBLING

3.1.The Gambling Act, in terms of section 78 (1), prohibits the gambling by any person under the age of 18 years.

3.2.You, if You are under the age of 18 years, shall not be entitled to engage in Transactions with BetXchange.  

3.3. In the event that BetXchange should establish that You are under the age of 18 years it shall immediately terminate your ability to utilise the Account and more particularly to transact further Transactions and to cancel any Transactions where the event concerned has not been completed and to report You to the Gambling Board and to pay to them the extent of any credit in your account. In addition, BetXchange shall be entitled to void and to cancel any successful Transaction/s between the person concerned and it.

4.    THE CONCLUSION OF A BETTING TRANSACTION

4.1.BetXchange will display on its Website betting odds relative to the outcome of various sporting events.

4.2.Each time that You seek to place/take a bet with BetXchange through the Electronic Agent, this will constitute an offer by You to BetXchange to transact a particular Transaction, which offer will then be open for acceptance by BetXchange,  which offer is always made by You on the express condition and understanding that You are doing so subject to BetXchange’s standard terms and conditions (which prevail at that time) read with Parts C and D hereto.

4.3.When BetXchange through the Electronic Agent accepts Your offer relative to a Transaction made by You a binding agreement between You and BetXchange will occur which agreement You will not be able to change and/or cancel.

4.4.Even though BetXchange confirms that your offer relative to a Transaction has been accepted by it this does not mean that BetXchange is bound by the Transaction i.e. BetXchange whenever certain events arise (see Terms and Conditions numbers 6, 7, 9, 11, 12, 16.3 and 17) is entitled to either amend and/or cancel the relevant Transaction/s.

5.    SPECIFIC RULES RELATIVE TO EACH SPORTING EVENT

You agree and understand that each sporting event has its own rules, which rules determine whether the specific sporting event results in an outcome and more particularly an outcome which may result in the success of a particular Transaction. You hereby record and confirm that You have read and understood these rules which are available on BetXchange’s Website and more particularly under Part C.

6.    LIMIT LIABILITY

6.1.BetXchange records that its liability to You in regard to a Transaction/s shall be limited to those amounts indicated in the win liability part, Part D of the Website, which part shall be incorporated by reference into this Part B.

6.2.Should the Electronic Agent, which has been instructed to automatically prevent Transactions amounts to be won in excess of the win limit amounts imposed in Part D of the Website, permit a win limit amount imposed to be exceeded,  then BetXchange shall be entitled , in its sole discretion, to reduce the Transaction maximum win amount to the win liability amount indicated in Part D (if necessary BetXchange shall be entitled to cancel the Transaction/s concerned and to replace it/them with a corrected Transaction/s in order to bring it/them within the win limit amount i.e. before, during or after the sporting event concerned has taken place and in which event  the amount staked will be combined and will not be subject to any reduction i.e. no refund of the amounts staked shall be payable to You).

6.3.In the even that You should transact a number of similar Transactions then BetXchange shall be entitled, in its sole discretion,  to treat the Transactions as constituting one Transaction and more particularly to ensure that You do not exceed the win limit amount that applies e.g. if You conclude a Transaction in regard to a horse racing Pick 6 in more than one instance and the winning combination occurs in  more than one Transaction then those Transactions may be treated by BetXchange as constituting one Transaction. In such event BetXchange shall be entitled to cancel all of the similar Transactions and to replace them with one Transaction and in which event the amount staked will be combined and will not be subject to any reduction i.e. no refund of the amounts staked shall be payable to You.

7.    ERRORS AND/OR CONDUCT AND/OR EVENTS GIVING RISE TO TRANSACTIONS BEING CHANGED DUE TO INCORRECT BETTING ODDS

7.1.In order for You to understand why BetXchange reserves to itself the right to change Transactions  it is necessary to again emphasise that the Computer System and/or the Electronic Agent may fail/malfunction and/or there may exist an error attributable to human error (e.g. the betting odds on a sporting event may be incorrectly typed into the Computer System/ Website e.g. odds of Brazil playing Bafana Bafana, incorrectly captured, as a result of a mistype, as 10/1 instead of 1/10) or unlawful conduct arising in the nature of hacking into the Computer System/Website and/or a third party (including an employee of BetXchange) unlawfully typing incorrect betting odds into the Computer System/Website e.g. higher betting odds than those indicated in the Computer System/Website.

7.2.You agree that BetXchange shall be entitled to change any Transaction/s with You (more particularly at any time and more particularly after the sporting event concerned has been completed) and as a consequence of any event or occurrence as indicated in 7.1. BetXchange shall be entitled to change the Transaction/s by cancelling the existing Transaction/s and replacing same with a substituted Transaction/s and more particularly to reflect the correct betting odds that should have been available at the time that the Transaction/s took place i.e. to cancel the original Transaction/s and to enter the amended Transaction/s into the Computer System and thereby to affect that Transaction/s against the Account.

7.3.The correct betting odds, as contemplated in 7.2, shall be those betting odds that BetXchange should determine as being the betting odds that were generally available in the local or the international betting market at the time that the Transaction took place. In the event that You should dispute the correctness of the betting odds that BetXchange applies then the onus will be on You to provide facts and evidence of greater betting odds than that applied by BetXchange.

8.    ERRORS AS TO TIME AND/OR DATE AND/OR PLACE AND/OR PARTICIPANTS IN A SPORTING EVENT

8.1. BetXchange records that either due to a human error and/or as a consequence of the failure/malfunction of the Computer System and/or the Electronic Agent and/or unlawful conduct and/or prohibited acts on the part of third parties and/or employees/agents of BetXchange, its Website may incorrectly reflect data as regards a sporting event i.e. as to the time and/or the date and/or the place and/or the participants in the sporting event.

8.2. In the event that BetXchange’s Website incorrectly reflects information as regards a specific sporting event and/or should an employee/agent of BetXchange convey incorrect information as regards a specific sporting event, You shall not be entitled to cancel the Transaction based on such incorrect information. You acknowledge that the onus will be on You to determine the correctness of any information as regards a sporting event (as regards time, date, place and/or participants and/or any other relevant information). Furthermore BetXchange will not be liable to You for any damages that You may allege you have suffered as a consequence of any incorrect information displayed on its Website and/or incorrect information conveyed orally to You.

9.      CANCELLED  TRANSACTIONS

9.1.      BetXchange shall be entitled, in its sole discretion,  at any time to cancel Transaction/s under the following circumstances:-

9.1.1. The sporting event concerned has already commenced and or has been completed at the time that the Transaction/s was/were concluded (this shall not apply to “in running” sporting events); and/or

9.1.2. The failure by the Computer System to suspend betting and thereby ensuring that the Electronic Agent does not accept offers from You (during the period that betting should have been suspended, Transactions with You    having taken place) - for example where the Computer System and more particularly BetXchange’s Internet server cannot be accessed by it as a result of the “freezing” of the Computer System and/or the satellite “feed” malfunctioning in any respect, BetXchange’s intention to suspend betting in order to change the betting odds as a consequence of the happening of an event e.g. a goal having been scored, a try having been scored, a wicket having fallen, odds having been claimed, change in the jockey, horse scratching, change in the identity of the participants.

9.2. The cancellation by BetXchange of the entire Transaction shall only apply as regards single Transactions. Where a customer transacts multiple betting transactions in the same Transaction and when a situation of cancellation arises i.e. as regards one part of the Transaction then only that part of the Transaction shall be cancelled and the remaining portion of the Transaction shall remain valid e.g. a multiple betting transaction is transacted where the first leg is Manchester United v/s Liverpool (which event does not take place within 48 hours of the advertised time) and the second leg is Brazil v/s Bafana Bafana i.e. in this instance the first part of the multiple will  automatically cancel and the second part of the multiple will remain i.e. the multiple will in fact be reduced to a single Transaction. 

9.3. In the event that BetXchange should cancel a Transaction the amount staked by You shall be refunded to You and more particularly Your Account shall be credited with that amount.

10. CREDITS (WINNINGS) CREDITED TO YOUR ACCOUNT IN ERROR

10.1. You agree that it will be your obligation to check that all credit payments (arising from winning dividends from Transactions) that are credited to the Account accords with results of sporting events that are correct (in the case of Tote declared dividends that these accord with the dividends actually declared by the Tote).

10.2. In the event that BetXchange credits the Account with the incorrect winning dividend amount (as declared by the Tote) or as a result of the incorrect declaration of a sporting event result, then BetXchange shall be entitled to reverse the incorrect credit amount from the Account and, where applicable, to recover any over payment that may have been made to You.

11. MULTIPLE TRANSACTIONS

11.1.BetXchange records that You subject to 11.2 and 11.3 shall be entitled to conclude multiple Transactions and more particularly which involves the outcome of one or more sporting events which if successful result in the gross amount (the winnings and the amount staked) being taken forward to the sporting event that occurs next in time and date (commonly known as “all to comes”).

11.2. Subject to 11.5 You confirm and accept that You are prohibited from transacting multiple Transactions (all to comes) where the outcome of one part of the Transaction contributes to the outcome of another part of the Transaction. An example of a prohibited multiple bet would be the Crusaders to win the rugby game and the Crusaders to win the rugby game by 1 point.

11.3. The prohibition as regards “all to come” Transaction/s shall also extend to Transactions where it involves the same teams/in the same tournament - for example a prohibitive multiple bet would be Manchester United to win the first round of the FA Cup and it to win the FA Cup.

11.4. In the event that the Electronic Agent should permit a prohibited multiple bet Transaction as indicated in 11.2 and/or 11.3 for any reason whatsoever, then BetXchange shall settle the bet by equally dividing the stake unit where related outcomes clash.

11.5. The prohibitions recorded in 11.2 and 11.3 shall not apply as regards specific sporting events (as indicated in the Rules – Part D) which physically take place in North America. In this regard You will be able to transact certain multiple betting transaction in the same sporting event e.g. team A to win by more than 10 points and the total points of the game to exceed 20 points.

12. PROHIBITION AGAINST SYNDICATE TYPE OF TRANSACTIONS

12.1. You undertake not to form or become part of any type of betting syndicate and more particularly for the purposes of circumventing these terms and conditions and by way of example the limit liability exposure of BetXchange.

12.2. In the event that BetXchange should determine that You have breached the undertaking indicated in 12.1 then it shall be entitled to:-

12.2.1. cancel and/or void any of your current Transactions and to refund the amount staked by you; and/or

12.2.2. cancel/ and/or void any previously successful Transaction/s and if applicable to recover from You any debit balance of the Account that then arises.

13. BETTING TAX

All successful Transactions are not subject to betting tax save that betting  tax being equal to 6% on the winning amount in regard to horse racing applies and where multiple Transactions are transacted where one part of the transaction is a horse racing event. You confirm and agree that BetXchange shall be entitled to deduct betting tax on all winning Transactions involving horse racing events.

14. PROHIBITION AGAINST CESSION OF THE ACCOUNT AND/OR ANY TRANSACTION/S

14.1.  You undertake in favour of BetXchange not to cede any of the credit proceeds of the Account and/or your rights to operate the Account and more particularly to conclude Transaction/s.

14.2.  You undertake in favour of BetXchange not to cede any Transaction/s or a part of any Transaction/s.

14.3.  In the event that You should contravene the undertakings indicated in 14.1 and/or 14.2, BetXchange shall be entitled to close the Account and in the case of a contravention of term 14.2 to cancel the Transaction/s concerned.

15. PAYMENT OF  AMOUNTS STANDING TO THE CREDIT OF THE ACCOUNT

15.1.  You shall be entitled to withdraw credit amounts from the Account and at any time.

15.2.  You agree that should You wish to withdraw credit amounts from the Account then:-

15.2.1.You shall dispatch an electronic message to BetXchange to this effect or request same telephonically; and

15.2.2.You agree that BetXchange shall only be obliged to give effect to your instruction by depositing the amount requested into a bank account designated in your name or to pay You the amount in cash subject to it being paid to You personally; and

15.2.3.You confirm that the activation of Your request may take at least 72 (seventy two) hours and that any delay in the transmission/payment of the funds and more particularly the reflection thereof in Your banking account shall not give rise to any claim of whatsoever nature by You against BetXchange.

16. INCORRECT CREDITING OF AN AMOUNT / INCORRECT  CREDIT EXTENSION OF AN AMOUNT TO THE ACCOUNT

16.1. BetXchange records that due to human error and/or due to an error by its Electronic Agent/ Computer System and/or fraud and/or unlawful conduct by an employee of BetXchange and/or conduct attributable to You it may happen that an amount is incorrectly credited to the Account / an amount in the nature of a credit extension to the Account is incorrectly applied to the Account (hereinafter referred to as an “Event”). Examples of an Event are as follows:-

16.1.1. A payment into BetXchange’s banking account is incorrectly credited to Your  Account (in such event, You undertake to notify BetXchange of this fact and will in no way take advantage of this error); or

16.1.2. A purported payment by You into BetXchange’s banking account (which is then credited to the Account designated to You)  and which payment is subsequently reversed by the banking institution/s concerned or is never reflected for whatsoever reason into the banking account of BetXchange; or

16.1.3. The incorrect result of a sporting event is entered into the Computer System and which then gives rise to an incorrect credit being reflected in the Account ; or

16.1.4. An amount is credited to the Account arising from a Transaction which is either prohibited by BetXchange’s Standard Terms and Conditions or arising from a Transaction where a limit imposition has been breached or where the dividend  (in the case of a tote transaction) has been overstated.

16.2. In the event that and Event arises, BetXchange shall be entitled to reverse the credit amount in the Account. In the event that the reversal of the credit amount/s results in the Account reflecting a debit balance, then You undertake to effect payment of the debit balance within 48 (forty-eight) hours of the reversal taking place.

16.3. In the event that You should transact Transactions arising from the utilisation by You of a credit amount incorrectly credited to your Account (and arising from an Event) and/or should You utilise an incorrect credit extension amount (for example should the Computer System/ Electronic Agent fail to recognise a credit limit imposition amount applicable to the Account) then BetXchange shall be entitled to void and cancel all Transactions which were successful and to cancel all current/pending Transactions. In the case of Transactions which have not been successful and which You transacted (as a result of the Event) all such Transactions shall not be cancelled and in which event BetXchange shall be entitled to recover from you all amounts unsuccessfully staked.

17. CANCELLATION AND/OR TERMINATION OF AN ACCOUNT AND CANCELLATION OF FUTURE TRANSACTIONS

17.1. You agree that BetXchange may, without giving You any notice, terminate Your Account and to thereby cancel Your ability to transact any further Transactions with BetXchange and more particularly BetXchange shall be entitled to cancel any of Your future Transactions which relate to future sporting events.

17.2. You agree that BetXchange may take that action indicated in 17.1 if it should, in its absolute discretion deem that good cause exists  to do so, without limiting the generality of the aforegoing this shall include:-

17.2.1.belief that You are engaging in illegal and/or fraudulent activities; and/or

17.2.2.belief that You have or are in the process of breaching these terms and conditions.

17.3. You agree that if BetXchange should take the action indicated in 17.1 it shall be entitled to immediately cancel all and any Transaction/s including “all to come” Transaction/s where all parts of such Transactions have not been completed.

18. RESOLUTION OF DISPUTES

18.1. BetXchange records that Chapter 5 of the Regulations promulgated in terms of the Gambling Act makes provision that a disputed claim for payment of a gambling debt may be resolved by the Gambling Board, which dispute is referred in the first instance to its Chief Executive Officer and in the second instance (on appeal) to the Gambling Board.

18.2. You agree that prior to referring any dispute (arising from the failure by BetXchange to pay You an amount arising from a successful Transaction contended for by You,) as contemplated in the recordal indicated in 18.1,  to refer the dispute to GOBA,  and in which event You agree as follows:-

18.2.1. To advise GOBA in writing of the nature of the dispute and to invite it to determine the dispute; and

18.2.2. To make yourself available at the hearing that GOBA may hold and more particularly to permit yourself to be questioned by GOBA and/or BetXchange (which shall extend to their legal representatives); and

18.2.3. To make available to GOBA any relevant document/s as may be directed by it; and

18.2.4. That GOBA shall be entitled to order that its costs and/or any other parties costs shall be paid by You i.e. in the event that the dispute should be determined against You.

18.3.You agree that should You:-

18.3.1. Fail to attend at the hearing convened by GOBA; and

18.3.2. Fail to submit yourself to be questioned by GOBA and/or any other party including BetXchange,  that has an interest in the dispute and/or fail to submit any document/s ordered to be produced, then You agree that Your rights to proceed and to refer the dispute in terms of the Regulations promulgated in terms of the Gambling Act shall be suspended, i.e. until You have fully and satisfactorily permitted the hearing before GOBA to be held and completed, and thereby permitting GOBA to issue a ruling thereon.

18.4. In the event that a ruling by GOBA is not in Your favour then You shall  either be entitled to accept the ruling and if not You shall be entitled to exercise the rights as recorded in 18.1. Furthermore and in the event that GOBA does not commence with a hearing within 3 (three)  months of the delivery of the notice contemplated in 18.2.1 or it does not deliver a ruling  within 6 (six) weeks of the conclusion of the hearing then in such event You shall be entitled to exercise the rights as recorded in 18.1.

18.5. In the event that the ruling delivered by GOBA is in Your favour BetXchange shall be entitled to accept it or reject it. In the event that BetXchange does not advise you that it accepts the ruling by GOBA within one week of it having been handed down the You may presume that BetXchange has rejected same.

19. LIMITATION OF LIABILITY

You agree that BetXchange shall not be liable for any losses and/or damages that You may sustain of whatsoever nature and from any cause whatsoever (hereinafter referred to as the/these “occurrences”) arising from any Transactions i.e. either Transactions that have been concluded and/or Transactions that You sought to conclude with BetXchange and/or Transactions that have been varied and/or cancelled by BetXchange.  Without limiting the generality of the aforegoing, these occurrences shall include:-

19.1. Power failures; and/or

19.2. Telecommunication failures; and/or

19.3. Computer System / Electronic Agent failures; and/or

19.4. Any other act and/or omission by any of BetXchange’s employees, agents and/or service providers (without limiting the generality of the aforegoing, these shall include the displaying/conveying of incorrect information as regards a particular sporting event i.e. as to the date and/or place and/or time and/or participants and/or incorrect results):- and /or

19.5. The failure to credit the Account timeously or at all relative to any payment effected by You; and/or

19.6. The failure to credit the Account timeously or at with an amount arising from a successful Transaction/s; and/or

19.7. The conveying of incorrect details as regards a particular sporting event i.e.as to the date and/or place and/or time and/or participants; and/or

19.8. Unlawful conduct by third parties including agents and/or employees of BetXchange.

20. APPLICABILITY OF THE ELECTRONIC ACT

20.1. It is recorded that in terms of section 20 (c) and (d) of the Electronic Act that You being a person utilising the Electronic Agent are not bound by these terms and conditions unless they were capable of being reviewed by You prior to each Transaction and more particularly the conclusion thereof.

20.2. You agree that the provisions of section 20 (c) and (d) of the Electronic Act shall not apply to You and more specifically to the Transactions that are concluded between You and BetXchange,  You hereby confirming that these terms and conditions have in fact been reviewed, read and understood by You, and that these terms and conditions will form an integral part of each offer that You extend to BetXchange i.e. BetXchange will accept each Transaction offer by You subject to these terms and conditions.

21. WAIVER

You agree that failure and/or delay by BetXchange in exercising any of its rights in these terms and conditions shall not operate as a waiver by BetXchange as regards it exercising any of its rights in terms of these terms and conditions and at any time.

22. AMENDMENTS TO, VARIATIONS AND CANCELLATIONS OF TERMS AND CONDITIONS

BetXchange reserves to itself to amend and/or vary and/or cancel these terms and conditions at any time in the future and as soon as these amendments and/or variations and/or cancellations have been displayed on its home page, then these terms and conditions shall automatically be amended and/or varied and/or cancelled taking into account the said changes.

23. CERTIFICATE

A certificate signed by a representative and/or agent of BetXchange shall be prima facie proof of any indebtedness owed by You to BetXchange,  the production of which certificate will discharge any onus on BetXchange to prove the existence and/or the extent of the indebtedness by You to BetXchange.

24. LEGAL COSTS

In the event that BetXchange is obliged to take any legal action against You and should it be successful with such legal action then You will be liable for all of BetXchange’s legal costs and on the scale as between attorney and own client.

25. ADDRESS FOR SERVICE OF NOTICES AND LEGAL PROCESSES BY BETXCHANGE ON YOU

You choose as an address for service of all notices and/or legal processes the address that You have furnished in the opening account section of BetXchange’s Website.

26. APPLICABLE LAW

All Transactions, (where any of these terms and conditions are subject to any Law), shall be subject to the Laws and more specifically governed thereby, and where applicable You agree that  any and all legal proceedings shall be instituted and determined by the relevant High/Magistrate Court in South Africa.

GENERAL RULES GOVERNING ALL SPORTING EVENTS

27. DEAD HEATS

27.1. In any sporting event where a dead heat (draw) relative to the outcome of the sporting event is not offered as a betting opportunity (this shall exclude all one day cricket sporting events and certain sporting events conducted in North America) then the Transaction shall not be capable of being cancelled. The determination (extent) of the pay-out arising from a drawn sporting event, will be determined by dividing the amount staked (by You) by the number of persons/teams/participants who form part of the dead heat and adding thereto the amount of the contemplated pay-out divided by the number of persons/teams/participants who form part of the dead heat (an example whereof is indicated in 27.2).

27.2. You transact a Transaction of R200 to R100 on team A which dead heats with team B. Your return will be half of R200 plus half of R100 i.e. your return will be R150.

28. SUBSEQUENT AMENDMENTS TO THE OUTCOME OF SPORTING EVENTS INCLUDING DISQUALIFICATIONS AND/OR PROMOTIONS

The result of all sporting events shall be those results as declared at the conclusion of the sporting event concerned itself and more particularly in the case of horse racing events the giving of the “all clear”. In the event that subsequent to the declaration of an outcome/result (of a sporting event) a different result is declared (for example arising from the disqualification of a person/team/animal from a particular position and arising from a positive dope test) then such different result/outcome will have no effect on the original result/outcome of the sporting event concerned.

29. SPORTING EVENTS THAT HAVE COMMENCED AND THEREAFTER ARE ABANDONED AND/OR POSTPONED TO A LATER DATE

29.1. In the event that a horse racing event (as an individual or a number of horse racing events on the same day) does not take place on a specific day and is postponed to a later date (within a 48 (forty-eight) hour period) then all Transactions shall remain.

29.2. In the event that any other sporting event, apart from a horse racing event,  commences and is thereafter abandoned/postponed to a later date then BetXchange, in its sole discretion, shall determine whether all Transactions relative to such sporting events shall be cancelled alternatively shall remain. BetXchange, in the event that it should cancel any Transaction relating to an abandoned/postponed sporting event (not a horse race that takes place within 48 hours of the first advertised time of such horse race) which thereafter commences at a later date, shall attempt to communicate same to You but in the event that it does not do so You shall not be entitled to claim the existence of a Transaction, (in which event You will be entitled to a refund of the amount staked).

30. HORSE RACING EVENTS WHICH ARE MOVED TO ANOTHER VENUE AND/OR A DIFFERENT RACING SURFACE

30.1. In the event that a horse racing event is relocated to a different race horse track i.e. from that originally advertised, then all Transactions shall be void and You shall be entitled to a refund of the amount staked.

30.2. In the event that a horse racing event is changed from one surface to another e.g. grass to sand then all Transactions shall be void and You shall be entitled to a refund of the amount staked.

31. CHANGES TO PARTICIPANTS IN SPORTING EVENTS AND CHANGES OF A GENERAL NATURE

31.1. In the event that any changes to the participants in a sporting event takes place (before or during) i.e. after the Transaction concerned has been concluded, the Transaction shall not be capable of being cancelled by You.

31.2. In the event that any changes take place before a horse racing event takes place i.e. after a Transaction has been concluded (e.g. a change of the jockey, the type of shoes on the horse and/or any other equipment change) then the Transaction shall not be capable of being cancelled by You.

32. PROMOTIONS

32.1. From time to time BetXchange may devise opportunities, in the form of promotions, for You to possibly be paid amounts, arising from a Transaction that has been unsuccessful or amounts in excess of that contemplated in a particular Transaction (hereinafter referred to as the “Promotional Event”).

32.2. BetXchange may from time to time advertise at its betting outlets and on its Internet Website the Promotional Event and the rules that will govern such Promotional Event, such rules will be those as indicated in Part C hereof.

32.3. Should any Transaction transacted by You fall within the rules of any Promotional Event i.e. giving rise to the possibility of You becoming entitled to an additional credit amount, then it will be Your obligation to advise BetXchange, in writing, (by electronic mail) that the Transaction falls within the Promotional Event. You shall be obliged to notify BetXchange within 48 (forty-eight) hours of the time that the outcome of the Promotional Event has occurred i.e. should you fail to do so timeously BetXchange shall not be obliged to consider whether it should pay You (credit the Account) the extent of the amount as contemplated in the rules of the particular Promotional Event.

32.4. On You timeously advising BetXchange of that matter indicated in 32.3, BetXchange shall be entitled, in its sole discretion, to award You the opportunity as contemplated in the Promotional Event. In the event that BetXchange shall award You the opportunity it will credit Your Account with the extent thereof subject to any limit amount that BetXchange has imposed as regards the Promotional Event.

32.5. In the event that BetXchange credits Your Account with an amount  then such amount shall not be capable of being withdrawn by You from the Account. The entire extent of the amount shall be utilised by You as regards future Transactions and only winning amounts that arise from those future Transactions shall be capable of being withdrawn by You from the Account i.e. under no circumstances shall any amount, arising from a Promotional Event, be capable of being withdrawn by You from the Account. 

33. MATCH AND/OR SPECIFIC EVENT FIXING

33.1. In the event that BetXchange should suspect that a specific sporting event and/or an event within a sporting event has been manipulated (hereinafter referred to as “Match Fixing”) then it shall be entitled to delay payment of successful betting transactions which relate to the Match Fixing sporting event and/or a specific transaction within a sporting event.

33.2. BetXchange shall be entitled to delay payment of successful betting transactions arising from the Match Fixing event indicated in 33.1 for a period not exceeding 6 months or for such later period if the sporting event and/or the event within sporting event is the subject matter of continued investigations by the relevant sporting authority and/or gambling authority.

33.3. In the event that the relevant sporting authority and/or gambling authority determine the existence of Match Fixing then the betting transaction shall be void and the stake shall be refunded.

33.4. In the vent that the relevant sporting authority and/or gambling authority does not determine the existence of Match Fixing or within 6 months BetXchange has not been successful in furnishing facts and/or evidence of Match Fixing then he betting transaction concerned shall be payable by it.

American Football

Includes NFL, NCAA College Football, WLAF, UFL, CFL and Arena Football.

Abandoned or postponed matches are void unless rearranged and played in the same NFL weekly schedule (Thursday - Wednesday local stadium time) except for those bets that have already been determined at the time of abandonment or postponement.

If a match venue is changed, bets already placed will stand providing the home team is still designated as such. If the home and away team for a listed match are reversed, then bets placed based on the original listing will be void.

In 2-Way markets Push rules apply unless otherwise stated below. Stakes on single bets are returned, and in multiples/parlays the selection is treated as a non-runner.

Weekly Props - Total Points Scored, Conference Points Scored, Will There Be A Shutout; will be inclusive of the number of games as specified on site for each specific week. In the case of one or more of those specified games being abandoned/postponed markets will be void unless they are rearranged and played in the same NFL weekly schedule (Thursday - Wednesday local stadium time), or the outcome is already determined.

Weekly Markets - Highest/Lowest Scoring Team and Player Yardage markets, only the quoted participant’s count. Any Team or Player who are involved in an Abandoned or Postponed match will be treated as a non-runner and other participants subject to Rule 4 (Deductions) unless game is rearranged and played in the same NFL weekly schedule (Thursday - Wednesday local stadium time).

 

Pre-Game Bets (Game Lines Including 2nd Half/4th Quarter Bets) INCLUDE Overtime Unless Stated Otherwise

There must be 5 minutes or less of scheduled game time left for bets to have action, unless the specific market outcome is already determined, unless stated otherwise. All NFL match markets and pre-game props will be settled according to game stats on www.nfl.com published on day of the game. Subsequent amendments do not affect settlement.

Double Result - Predict the result at half-time and end of regulation time. The game must be completed for bets to have action. This market EXCLUDES overtime for settlement.

1st Quarter/Match Double – Predict the result at the end of the 1st Quarter and the end of regulation time. The game must be completed for bets to have action. This market EXCLUDES overtime for settlement.

Lowest/Highest Team Score - Only listed teams count. Dead-heat rules apply.

For pre-game props the game must be completed for bets to have action, unless settlement of bets is already determined.

Team Totals, Odd or Even - Zero score by a team will count as Even for settlement purposes.

Team to Call 1st Timeout - Forecast which team will call the 1st timeout. Timeouts lost by any other means, e.g. Coaches Challenges, Injuries etc. do not count.

Will Either Team Score 3 Unanswered Times - Forecast whether either team will score 3 consecutive times during the game. A Score excludes any PAT's (point after touchdown or 2 point conversions).

First Offensive Play of the Game - This market is determined by the first offensive play from scrimmage (excluding Penalties). In the event of the kick-off being returned for a touchdown then bets will stand for the following kick-off. Incomplete or intercepted passes and QB Sack or Fumble will stand as a Pass Play. A fumble on exchange to the RB will stand as a Run Play.

Total Offensive Yards - Settlement is based on the Net Yards for both teams (includes sack yardage lost).

Team to Gain Most Passing Yards – Settlement is based on the most gross yards thrown.

Team to Gain Most Rushing Yards – Settlement is based on the most Total Rushing yards gained (includes negative yardage).

Penalties - All Penalty markets are based on the Penalty being accepted. Declined Penalties do not count.

Player Props/Performances - Bets are action if player competes in one Down. Player match-ups are action if both players compete in one Down. Push rules apply.

For the following markets your player must be dressed/active for bets to stand (as per the official NFL Game Book):-

First/Last and Anytime Touchdown Scorer - Forecast the name of the scorer of the first/last/anytime touchdown in the game, or whether no touchdown will be scored. The Field refers to any player not specifically listed.

Touchdown Shirt Numbers - If no touchdown scored then all bets are no action.

Scorecast - If a match is abandoned after a touchdown has been scored all bets will be settled as singles on the selected first touchdown scorer at the appropriate odds. If there is no touchdown scored in the match then all bets will be settled as singles on the Winning Margin.

Quarterback props are based on Gross Passing Yards gained.

 

Pre-Game Prop Bets Which EXCLUDE Overtime

For the following markets the game must be completed for bets to have action:

Double Result - Predict the result at half-time and end of regulation time.

 

In-Play Game Bets/In-Play Half Bets/In-Play Quarter Bets INCLUDE Overtime Unless Stated Otherwise

The game or relevant quarter/half must be completed for bets to have action, unless settlement of bets is already determined.

Half bets (2nd half will include any points scored in Overtime if played unless otherwise stated)

Double Result - Excludes overtime if played.

2 Unanswered Scores in Quarter/Team to Make Next Score/Next Scoring Play - PATs do not count as scores.

Result of Current Drive - If Team A has the ball and fumble, and the ball is recovered by Team B, who then fumble it back to Team A; the outcome will be settled as Turnover, due to possession changing hands twice. Turnover on Downs (failed 4th Down attempt) will be settled as turnover. If a punt is fumbled by the receiving team and recovered by the kicking team bets will be settled as punt and a new drive market will be offered.

Make 1st Down on Current Drive - The Yes option is determined by achieving a new set of downs, either by Run, Pass (this includes if a TD is scored as a result) or Automatic 1st Down Penalty. Safety, and Field Goal will be settled as No (irrespective of Field Goal being made or not). Replayed Downs due to non-Automatic Penalties, e.g offside, encroachment, delay of game, Illegal substitution, excessive timeout(s), incidental grasp of facemask, neutral zone infraction, running into the kicker or more than 11 players on the field at the snap, do not count, unless committed with 5 yards or less to go.

 

Parlay Cards

In the case of any of the selections resulting in a tie the selection will be treated as a Push and the parlay will stand on the remaining selections, e.g. a 4 team parlay with 1 tie will revert to a 3 team parlay on the 3 remaining selections, a 2 team parlay with 1 tie will revert to a single wager on the remaining selection, in all cases at the odds taken at the time the wager was placed.

 

Teaser Cards

In the case of any of the selections resulting in a tie the selection will be treated as a Push and the teaser will reduce to a parlay on all the remaining selections, e.g. a 6 team teaser with 1 tie will revert to a 5 team teaser on the 5 remaining selections, a 4 team teaser with 1 tie will revert to a 3 team teaser on the remaining 3 selections, in all cases at the odds taken at the time the wager was placed. If any teaser falls below the required minimum (3 selections for NFL, or 2 selections for NCAAF) the bet will become void.

 

Teasers

In the case of any of the selections resulting in a tie the selection will be treated as a Push and the teaser will reduce to a parlay on all the remaining selections, e.g. a 6 team teaser with 1 tie will revert to a 5 team teaser on the 5 remaining selections, a 4 team teaser with 1 tie will revert to a 3 team teaser on the remaining 3 selections, in all cases at the odds taken at the time the wager was placed. Where a Push results in a teaser being reduced to one selection, the teaser will be treated as a single and paid out at the appropriate odds.

 

Season Props

All season props are based on the regular season matches only. Players stats stand irrespective of any trades during the regular season. All bets are action regardless of number of games.

 

Futures/Season Bets

Super Bowl winner, Conference Outright and Divisional Outright bets stand regardless of the length of the season.

NFL regular season wins and match-ups are based on teams completing all 16 regular season games, and for CFL all 18 regular season games, unless the remaining games during the course of the season do not affect the result.

AFC/NFC Conference winners are determined by the teams progressing to the Superbowl.

NFL Divisional winners are determined by games won during the regular season (NFL tie-break rules apply).

Conference Wildcard winners are the 2 teams who qualify for the post-season via the NFL's Wildcard selection.

Conference Number One Seed winner is the team designated by the NFL as the team who will have Home Field advantage throughout the playoffs.

NFL/NCAAF regular season wins and match-ups are based on teams completing the minimum number of games specified.

CFL to Reach Grey Cup - The team that progresses to the Grey Cup Final will be deemed the winner of the respective division.

 

Conference/Division Betting

Teams participating in an outright tournament may be grouped in conferences and/or divisions. For example NFL is grouped into 2 conferences (American Football Conference and National Football Conference) each containing 4 divisions (North, East, West and South). Prices are offered for each participating team to win their respective division and conference.

Olympics/European and World Championships - Outright/Group/Heat/Round/Tournament Betting
All bets stand except for those placed on participants not competing in first round heats/qualification. Participants awarded gold, silver and bronze medals at the medal ceremony will be deemed 1st, 2nd and 3rd respectively for betting purposes. We reserve the right to apply a deduction in the event of a withdrawn participant prior to the start of an event.

Match-Ups
Both competitors must compete for bets to stand.

Bets on players taking no part in the match will be void. If your player takes the field after a goal has been scored then the first goalscorer bet will be made void. If your player has taken the field at any time prior to the first goal being scored then your bet stands. Any Other Player option, incorporates any player not listed, for settlement purposes.

Each-way bets on goalscorers who have taken no part of the game when the 1st goal is scored will be void regardless whether or not they score later in the game. If there are less goals scored than the Each-way number of places offered then bets on players who have not scored will be settled as losers. No extra payments will be made where an individual player scores more than one of the first four goals.

Bets will stand on players that take any part in a match for last goalscorer purposes.

Best On Ground
Settlement will be based on the player judged to be the Medal Winner in the specified match. Bets on players taking no part in the match will be void. Dead-heat rules apply.

Highest Scoring Half
If both halves finish equal then bets will be settled as a tie. If a game goes to overtime then this will be included for settlement purposes (considered a continuation of the 2nd half).

Race to 20 Points
Bets will be settled on first team to reach 20 points.

Tribet
If the match ends in a Tie, bets will be settled as Any Other Result option.

Quarter by Quarter
Bets will be settled on the sequence of quarter leaders, during the match. If the match is tied at the end of any quarter, then the market will be settled as Any Other Result. If a game goes to Overtime then this will be included for settlement purposes (considered a continuation of the 4th quarter).

For player based markets, bets will be refunded on individual players if they are not amongst the starting 18 or 3 interchange players. Disposal markets are settled on the listed players only. For player head to heads both players must be in the starting 18 or be one of the 3 interchange players. The player named as the “sub” will be considered a non player for betting purposes.
 

AFL Dream Team Special Markets
Most AFL Dream Team Points for the Round - The winner is deemed the player with the most AFL Dream Team points (from the quoted list) for the Round. Results as per afl.com.au. In the event of non starters (including players named as the “sub’’), a Rule 4 (Deductions) may apply.

Brownlow Medal - Winner is deemed the player awarded the medal.

Brownlow Medal Top 3/5 Finish - Settlement is based on the finishing position at the time the medal is awarded. Ineligible player votes count. Dead-heat rules apply.

Brownlow Medal Most Team Votes - Winner is deemed the team to get the most number of votes. Ineligible player votes count. Dead-heat rules apply.

Brownlow Medal Most Individual Player Club Votes - Winner is deemed the player to get the most number of votes. Ineligible player votes count. Dead-heat rules apply.

Season Betting
With the exception of Premiership winner, AFL seasonal markets offered will be regular season only, and based on the official AFL ladder. If in any market teams are tied, the winner will be deemed the team with the best percentage. (worst percentage for Wooden Spoon).

Most Losses (Regular Season) - Settled on the team recording the most losses during the regular season. In the event of two or more teams recording the same number of losses, the winner will be determined as the team with the worst for and against differential. Regular Season must be completed for bets to stand.

All games must start on the scheduled date (local time) for bets to have action. If a game has been postponed or cancelled before its due start time then all bets are deemed no action.

Non-MLB Baseball (including Minor League Baseball) - No listed pitchers and all bets are action regardless of who pitches for each team. 8½ innings rule applies although in the event of a Mercy Rule being called, all bets will stand on the score at the time. For 7 innings games played as part of a doubleheader the 6½ inning rule will apply.

In 2-Way markets Push rules apply unless otherwise stated below. Stakes on single bets are returned, and in multiples/parlays the selection is treated as a non-runner.

MLB Wagers
It is the client's responsibility to ensure they are aware of any relevant pitcher changes. For game Money Line/Total/Run Line Betting there are three options to choose from:

Action -Team against team regardless of the starting pitcher. Each team's starting pitcher is defined for wagering purposes as the pitcher that throws the initial pitch. Pitchers can be specified when placing wagers.

One Specified Pitcher - A wager on or against one specific starting pitcher regardless of the other starting pitcher. Specified pitcher must start or wager is deemed no action.

Listed Pitchers Must Start - A wager that specifies both starting pitchers. Any variation constitutes no action. Wagers with One Specified Pitcher and Listed Pitchers Must Start that were placed when the named pitcher was originally listed are no action if the listed pitcher is changed and is then re-listed back to the original pitcher.

Wagers placed on the named pitcher, after being re-listed, are action.

In the event of a change in one or both starting pitchers prior to the start of a baseball game then the Money Line/Total/Run Line Betting may be adjusted. If one scheduled starting pitcher starts against an unscheduled starting pitcher, or both starting pitchers were unscheduled, then all Action and live One Specified Pitcher wagers will be computed at the opening price/line established with the new starting pitcher(s).

Double pitching change, where a listed pitcher is changed then re-instated for betting purposes, bets will be treated as a normal pitching change.

For any suspended MLB playoff game that resumes within 72 hours of the suspension, all bets will stand and be settled after the completion of the game. If the game is not completed within 72 hours following the time of suspension, then all bets will be void unless settlement of bets is already determined.

Matches Not Played as Listed
If a match venue is changed then bets already placed will stand providing the home team is still designated as such. If the home and away team for a listed match are reversed then bets placed based on the original listing will be void.

4½ Innings Rule
Money Line - There must be at least 5 full innings of play unless the team batting second is leading after 4½ innings, for bets to stand. If the game is called, or suspended, after this point of the game is reached, then the winner is determined by the score after the last full inning (unless the team batting second scores to tie, or takes the lead in the bottom half of the inning, in which case the winner is determined by the score at the time the game is called). Please note that suspended games do not carry over (with the exception of MLB play-off games - see specific rule). However, in the event of a Mercy Rule being called, all bets will stand on the score at the time.

6½ Innings Rule
Total and Run Line betting (for 7 innings games) - The game must go at least 7 full innings (or 6½ innings if the team batting second is ahead) for bets to have action. However, in the event of a Mercy Rule being called, all bets will stand on the score at the time. Please note that suspended games do not carry over.

8½ Innings Rule
Total and Run Line betting - The game must go at least 9 full innings (or 8½ innings if the team batting second is ahead) for bets to have action. However, in the event of a Mercy Rule being called, all bets will stand on the score at the time. Please note that suspended games do not carry over (with the exception of MLB play-off games - see specific rule).

Pre-Game Lines
All pre-game bets include extra innings unless otherwise stated.
Where Mercy Rule is applied, all bets will stand on score at the time.

Money Line - Subject to 4½ innings rule.

Run Line, 3-Way Handicaps and Alternative Run Lines - Subject to 8½ innings rule.

Game Total, Team Totals, 3-Way Totals and Alternative Game Totals - Subject to 8 ½ innings rule EXCEPT where the total has already gone over, (if total has already gone over the quoted total, then bets on the over will be settled as winners, with bets on the under settled as losers) or where the natural conclusion of the game would have meant the outcome of the total quoted would be determined, e.g. MLB game is called, or suspended at 5-5, bets on Game Totals of Over 10 or 10.5 would be settled as winners, with bets on Under 10 or 10.5 being settled as losers, since any natural conclusion to the match would have at least 11 runs.

Most Hits, Total Hits, Team Hits - Subject to 8½ innings rule EXCEPT where the total has already gone over, where bets on the over will be settled as winners, with bets on the under settled as losers.

4½ Innings Totals - Bets will be settled based on the score in the middle of the 5th inning (e.g. not at the bottom of the 5th), unless the Total quoted has already gone over. Where this occurs all bets will be settled as follows - over bets on quoted Total will be settled as winners, with under bets on quoted Total being settled as losers.

4½ Innings Lines - Bets will be settled based on the score in the middle of the 5th inning (e.g. not at the bottom of the 5th), unless the team batting first is ahead (with any run line applied) at the start of the top of the 5th innings or score to go ahead (with any run line applied) in that inning, in which case the team batting first will be settled as the winner.

3/5/7 Innings Totals - Bets will be settled based on the score after 3/5/7 full innings, unless the total quoted has already gone over quoted total. Where this occurs all bets will be settled as follows - over bets on quoted total will be settled as winners, with under bets on quoted total being settled as losers.

3/5/7 Innings Line - Bets will be settled on the result after the first 3/5/7 innings of a game have been completed, unless the team batting second is already ahead (with any run line applied) at the middle of the relevant inning, or scores to go ahead (with any run line applied) in that inning, in which case the team batting second will be settled as the winner.

Pre-Game Props Including Player Props
Where Mercy Rule is applied, all bets will stand on score at the time.

Extra Innings Yes/No - Will be settled as Yes if the score is tied after 9 innings (or the statutory number of innings if this is not 9), even if later innings are not played for any reason.

When Will Most Runs Be Scored? - 8½ innings rule applies.

First HR Will Be? - Will be settled on the first HR hit in the game. Bets on “No HR” require the 8½ innings rule to apply to be settled as winners.
 

Match-ups

Most (Total) Bases*/Most Hits/Most Strikeouts - For these match-ups to have action both players must be in official starting line up. 8½ innings rule applies, unless both players, or the player losing the match-up, have already been substituted out of the game. Both listed pitchers (at time of placing wager) must start for bets to have action.

Player Performance: (Total Bases*/Total Hits/Total Strikeouts/To Hit a HR/Record a Walk/Record an RBI/Score a Run). The player must be in the official starting line up and the opposing listed pitcher (at time of placing wager) must start for bets to have action. 8½ innings rule applies, unless settlement of bets is already determined, either by the player achieving the required outcome or by being substituted out of the game without having done so.

*Total Bases are calculated by adding all hits a player makes as per Single = 1 Base, Double = 2, Triple = 3, Home Run = 4. Only these count.

Starting Pitcher Completed Innings - Pitcher must start for bets to have action. Bets will be settled based on the number of full innings that the starting pitcher pitches. Bets will be void if the game is called or suspended with the starting pitcher still in the game and not yet having reached the required number of innings.

Daily Props
These markets refer to a group of games played on a particular date. There are no Listed Pitchers (bets stand regardless of Pitchers changes).

Grand Salami is the total of all runs scored in the relevant games. All games must be played and go at least 8½ innings for action, even if the total goes over with some games postponed or called.

Homes vs Aways - All games must be played and go at least 8½ innings for action.

Highest Scoring Team - All games must be played and go at least 8½ innings for action.

Highest/Lowest Score of Night refers to total number of runs scored by any one team and Total Shutouts refers to the number of teams scoring no runs. For these markets only games going at least 8½ innings will be considered for settlement purposes.

Futures - General Rules

Regular Season Wins/Match-Ups - Team must complete at least 160 regular season games for bets to have action unless the remaining games during the course of the season do not affect the result.

Will there be a ‘’Perfect Game’’ in Regular Season - For the outcome to be settled as ‘Yes’, there must be an MLB regular season game in which a pitcher (or combination of pitchers) pitches a victory that lasts a minimum of 9 innings and in which no opposing batter reaches any base during the course of the game.

Regular Season Specials – All markets refer to season statistics accrued in MLB and are transferable between American League and National League. Statistics accrued in any other League do not count.

To Win Pennant - The team that progresses to the World Series will be deemed the winner of the pennant.

In the event of a fight being declared a No Contest all bets will be void and stakes returned, with the exception of markets where the outcome has already been determined.

To Win the Fight
In the event of a draw all bets will be void and stakes returned, this includes a fight which ends in a Majority Draw. Bets will be settled on the official result announced in the ring. Subsequent appeals/amendments do not affect settlement (unless the amendment was made due to human error when announcing the result).
All bets will have action regardless of changes to number of rounds to be fought.

Fight Outcome 5-Way
Draw or Technical Draw - Draw is scorecard draw. Technical Draw is if the referee stops the fight before the start of the 5th round, for any reason other than Knockout, Technical Knockout or disqualification.

KO or TKO - Knockout (KO) is when the boxer does not stand up after a 10 count. Technical Knockout (TKO) is the 3 knockdown rule or if the referee steps in. Any corner retirement will be considered a technical knockout (TKO), unless the fight is subsequently decided by the judges’ scorecards, or is a declared a No Contest.

Technical Decision - Decision is on scorecard points between the judges. Technical Decision is settled by the judges’ scorecards at any time other than at the end of the scheduled rounds.

All bets will have action regardless of changes to the number of rounds to be fought.

Total Rounds
For settlement purposes where a half round is stated then 1 minute 30 seconds of the respective round will define the half to determine under or over.
If the number of rounds for a fight is changed after this market has been set then all bets will still have action unless the new number of rounds result in the quote being higher than the total number of rounds to be fought.
For UFC specifically, where a half round is stated then 2 minute 30 seconds of the respective round will define the half to determine under or over.

Round or Group of Rounds Betting
If for any reason the number of rounds in a fight is changed then bets on round betting already placed will be void and stakes returned.

For betting purposes betting on rounds or groups of rounds is for a fighter to win by KO, TKO or disqualification during that round or group of rounds. In the event of a Technical Decision before the end of the fight all bets will be settled as a win by Decision.

In-Play
Fight Winner 3-Way - Includes quote for the draw.

Draw-No-Bet - In the event of a draw all bets will be void and stakes returned, this includes a fight which ends in a Majority Draw.

Fight Winner 2-Way - Offered for fights where no draw is possible e.g. Prizefighter.

Fight Outcome 5-Way - Refer to pre-game fight outcome.

Fight Outcome 4-Way - Offered for fights where no draw is possible e.g. Prizefighter.

Total Rounds 2-Way - Full round quotes are used. The Round in which the fight ends will be used for settlement purposes. In the event of a fighter retiring on his stool between Rounds e.g. 9 and 10, it will count as Round 9 for settlement purposes i.e. the last fully completed round.

Round Groups/Round Betting - For settlement purposes betting on rounds or groups of rounds is determind on fighter to win by KO, TKO or disqualification during that round or group of rounds. In the event of a Technical Decision before the end of the fight, all bets will be settled as a win by Decision. In the event of a fighter retiring on his stool between Rounds e.g. 9 and 10, it will count as Round 9 for settlement purposes i.e. the last fully completed round. For fights where a draw is not possible e.g. Prizefighter, the Draw or Technical Draw is not quoted.

To Go the Distance - For settlement purposes the official designated number of rounds must be fully completed for bets to be settled as Yes.

Prizefighter Competitions
To Win Outright/Name The Finalist/Final Forecast/To Reach The Final - Non-runner no-bet. The specified Prizefighter competition must be completed in full for bets to stand.

Winning Half - Name which half of the competition the winner will come from (Top/Bottom). The specified Prizefighter competition must be completed in full for bets to stand.

Stage of Elimination – Bets stand once a fighter is in the ring and the bell has sounded for the beginning of the specified fighter’s 1st round of the first competition bout. If a fighter withdraws prior to the first bout or a fighter withdraws from the competition in between bouts e.g. after winning a Quarter Final bout, but not facing the bell for the Semi Final bout; bets will be void.

For all Prizefighter bouts the Fight Outcome will be a 4 -Way market (no draw option). If a fight goes to the judges' scorecard and is tied, then the referee's decision will count for settlement purposes.

Additionally, if a boxer is stopped for a cut in any Prizefighter bout, this will count as TKO irrespective of which Round it occurs.

If a match is cancelled then all bets will be void if it is not replayed within 36 hours of its advertised start time.

Series Betting
Bets void if the designated number of matches changes, unless settlement of bets is already determined. If a series is drawn and no draw option is offered, bets will be void.

Race to 10 Runs
Bets stand unless either of the listed players do not open the batting, then all bets are void. Bets stand, regardless of which of the listed players faces the 1st ball. If neither player reaches 10 runs then the option Neither is the winner.

In weather affected matches, if neither of the batsmen reaches 10 runs and either are Not-Out then bets void. If neither of the batsmen reaches 10 runs and both are Out then Neither is the winning option.

The handicap is added at the end of the match. If the team batting first wins or ties the match then Runs Handicap will be used for settlement purposes.

If a team declares or reaches their target then the total amassed will be the result of the market. Bets will be void should no more play take place following the intervention of rain, or any other delay, as the ability to reach previous quotes offered will have been removed. If settlement of bets can be determined they will be settled accordingly. e.g. Should a team leave the field due to an intervention on a total of 135 then previous quotes equal to, or less than, this total will be settled. Settlement of Wagers
Statistics provided by the official score(s) provider or the official website of the relevant competition or fixture will be used to settle wagers. Where statistics from an official score(s) provider or official website are not available or there is significant evidence that the official score(s) provider or official website is incorrect, we will use independent evidence to support bet settlement.

In the absence of consistent, independent evidence or in the presence of significant conflicting evidence, bets will be settled based on our own statistics..

Outright Betting/Top Nationality Etc
Non-runner no-bet. Outright markets may be subject to a Deduction.

All outright bets are settled on the player awarded the trophy. The result of playoffs is taken into account. Dead-heat rules will apply to the Place bets.

Official tour site results at the time of trophy presentation are used for settlement purposes (subsequent disqualification after this time does not count).

A player is deemed to have played once they have teed off. In the event of a player withdrawing after having teed off then stakes will be lost on outright, group, match or 18 hole betting.

Where a tournament is reduced from the scheduled number of holes for any reason (e.g. adverse weather conditions) outright bets placed prior to the final completed round will be settled on the player awarded the trophy if 36 holes of the tournament have been completed. If less than 36 holes have been completed or outright bets were placed after the final completed round then bets will be void.

Skins Tournaments will be subject to dead-heat rules in the event of players winning equal amounts of prize money at the end of the specified competition. If additional holes are played to declare a single winner then this will be used for settlement purposes.

Outright Betting Including The Field
Non-runner no-bet apart from The Field. The price for The Field includes all players not quoted in this market. Bets are accepted win only. Above outright betting rules apply.

Betting Without a Nominated Player(s)
Dead-heat rules apply to win bets unless the excluded player(s) does not win the tournament. Dead-heat rules also apply to the Place bets.

Group Betting

The winner will be the player achieving the highest placing at the end of the tournament. Any player missing the cut will be considered a loser. If all players miss the cut then the lowest score after the cut has been made will determine settlement. Non-runner no-bet deductions in line with (Deductions) will apply. Dead-heat rules apply except where the winner is determined by a playoff.

If a tournament is affected by adverse weather bets will be settled providing that there is a deemed tournament winner and a minimum of 36 holes are completed. The winner will be the player in the lead at the end of the last completed round.

Finishing Position of a Named Player
In the event of a tie for a finishing position the tied position will count. For example, a tie with 5 other players for 8th place will count as a finishing position of 8th.

54, 72 and 90 Hole Match Betting
If a tournament is affected by adverse weather then bets will be settled providing that there is a deemed tournament winner and a minimum of 36 holes are completed. The winner will be the player in the lead at the end of the last completed round.

Official tour site results at the time of trophy presentation are used for settlement purposes (subsequent disqualification after this time does not count).

If one player misses the cut then the other player is deemed the winner. If both players miss the cut then the lowest score after the cut has been made will determine settlement.

If a player is disqualified or withdraws after starting, either prior to the completion of two rounds or after both players have made the cut, then the other player is deemed the winner.

If a player is disqualified during either the 3rd or 4th rounds, when the other player in the match bet has already missed the cut, then the disqualified player is deemed the winner.

A price will be offered for the tie and in the event of a tie bets on either player to win will be lost.

Tournament Match-Ups, (Tie is not offered)

As above but bets void in the event of a tie.

18 Hole Betting
The winner will be the player with the lowest score over 18 holes. Players are paired, they may or may not be playing together.

18 Hole - 2 and 3-Ball Betting
Bets stand once all nominated players tee-off the first hole. If a round is abandoned then bets on that round are void.

Bets on 2 or 3-balls will stand irrespective of whether the actual pairings/group may differ. For tournaments using the Stableford scoring system the highest points scorer during the round is deemed the winner. Non-runners - 2 and 3-ball bets void. In 2-ball betting where a price is not offered for the tie then bets will be void in the event of a tie. If a price is offered for a tie, this will govern settlement. In 3-ball betting dead-heat rules apply.

For all other bets involving groups of more than 3 players together over 18 holes (e.g. 7-ball, 9-ball, etc) Dead-heat rules apply. Non-runner no-bet. (Deductions) will apply.

Fourballs
Bets stand once both pairings have teed-off the first hole. For all other bets involving groups of more than 3 players together over 18 holes (e.g. 4-ball, 5-ball, etc) Dead-heat rules apply. Non-runner - no-bet. Deduction will apply.

Handicap Betting
Deduct handicap from final total to determine the winner. Tournament must be completed otherwise bets void. Any player who misses the cut will be deemed a loser. Any non-runner (Deductions) and SP Place terms will apply. Dead-heat rules apply.

Mythical Match-Ups
The winner will be the player with the lowest score over 18 holes. If scores are level after 18 holes then bets will be made void.

Player to Shoot the Lowest Round
Dead-heat rules apply.

Current/Next Hole Winner - 2 and 3 Balls
Bets stand once all nominated players tee-off the designated hole. If a player subsequently withdraws during the hole then bets on that player will be settled as a loser. Settlement of bets is determined when the players leave the green.

Current/Next Hole Player Score
A player is deemed to have played once they have teed off. In the event of a player withdrawing after having teed off on a specified hole, bets will be settled as ‘Over Par’. If a player withdraws before teeing off on a given hole, bets on that hole will be void.

Player Round/Hole Group Scores
Bets will be void if the named player does not complete the Round; or specified group of holes, unless settlement is already determined

Hole Group Winner
Bets are based on the score over a specified group of holes (e.g. 10-18). Bets will be void if a player does not tee off on the first of the specified holes. If a player subsequently withdraws during the hole group specified, then bets on that player will be settled as a loser.

End of Round Leader
Settlement is based on the tournament score at the end of the specified round. Dead-heat rules apply.

Any Player Under/Over Par On Hole
A player is deemed to have played once they have teed off. If a player withdraws after having teed off on a specified hole, their outcome will be treated as ‘Over Par’. In the event of one of the players not teeing off, bets on these markets will be void.

Match Play Markets
If a match does not start (e.g. player injured or disqualified before the start of a match) then all bets on that match will be void.

Bets on markets that can be settled by using the official tournament and match results (including final match correct score and individual match betting) will be settled using those results. This includes where a match finishes early either by agreement of the players or through injury.

Match Winner (2-Way) is settled on the winner including any extra holes played. Match Result (3-Way) and Winning Margin do not include extra holes if played.

Specifically for Winning Margin and Last Hole Played markets, if a match finishes before the completion of the stated number of holes, bets will be settled on the official result. Bets will be void if a player withdraws at a point in the match where the result is still to be determined. E.g. The number of holes remaining is greater than or equal to the score at the time of withdrawal.

For the Last Hole Played market, if a player withdraws after the 16th hole when the match is tied or after the 17th when a player leads by 1, then the Last Hole played is settled as Hole 18, since any natural conclusion to the match would require the 18th hole to be played.
Uncompleted single hole bets will be void.

Foursomes
Bets stand once both pairings have teed-off the first hole.

36 Hole Match Betting
Settlement will be on the player achieving the highest placing at the end of 36 holes. If the number of rounds played is reduced, e.g. for bad weather, bets will be settled providing that a player has won the trophy (bets will stand as long as there is a deemed winner and a minimum of 18 holes are completed).

If a player is disqualified or withdraws after starting prior to the completion of two rounds then the other player is deemed the winner.

A price will be offered for the tie and in the event of a tie bets on either player to win will be lost.

Ryder/Solheim/Walker/Warburg/Presidents Cup and Any Other International Matches
All markets, including Outright, Draw-No-Bet, Handicap(s), Top Points Scorer and Correct Score, Format Correct Score, Total Point Markets, will be settled on official result unless otherwise stated. In the Presidents Cup, To Lift Trophy (without the Tie option), dead-heat rules will apply.

Singles Matches
If an individual match-up ends in a tie and a tie is not offered then bets will be void.
If an individual match-up ends in a tie and a tie is offered then tie is deemed the winner.

Correct Score Markets
All scheduled matches must be completed in full for bets to stand regardless if matches are carried over.

Winner (Day) Markets
Settlement will be based on score after scheduled number of matches regardless if matches are carried over.

Score (Day-Format) Markets
Settlement will be based on score after scheduled number of matches in the specified format regardless if matches are carried over.

In the event of adverse weather affecting the tournament then settlement will stand as long as a minimum of 36 holes of a tournament are played.

Hole in One - Relates to a hole in one being recorded in the designated Rounds of a specified tournament. In the event of adverse weather affecting the tournament then bets will stand as long as a minimum of 36 holes of a tournament are played. In the event of a hole in one being recorded, but 36 holes not being played then the Yes option - To Make a Hole in One - will be deemed the winner.

To Make/Miss Cut - A tournament cut must be applied for bets to stand. In the case of a Tournament where a multiple cut system is in place, settlement will be defined by a player playing or not playing in the next Round following the 1st official cut.

To Win/Not to Win a Major - The 4 majors are US Open, US Masters, USPGA and the British Open.

Betxchange offers fixed odds on all South African meetings and also events of international interest, open bets are offered on all South African meetings and on most international meetings.

 

Ante post bets

(1) With the exception of starting price bets, should any selection not run for any reason other than the abandonment of the race itself –

(a) an ante post bet shall be lost and the customer shall forfeit his stake; and

(b) ante post bets struck on other horses/contestants in the race concerned shall not be subject to any adjustment in betting odds.

(2) Where a race is abandoned, all ante post selections that are still live or undetermined involving the race concerned, shall become void.

(3) Should a selected horse/contestant in any leg of a multiple event bet be scratched, withdrawn or not accepted prior to the bet becoming void or being won, the bet shall be regarded as lost, notwithstanding the fact that any included race is  abandoned.

 

Betting “with a run”

(1) Where a single bet is made “with a run” and the selected horse/contestant is scratched the bet shall become void.

(2) All bets struck “with a run” on the remaining horses/contestants in a race where one or more horses/contestants have been scratched, shall be subject to the deductions detailed in “deductions”.

(3) Where a deduction applies to remaining runners in any event of a multiple event bet “with a run”, the relevant deduction in terms of rule “Deductions” shall be applied to the runner/contestants of the event where the scratching occurred, and the entire bet recalculated in respect of the event from which the horse was scratched.

(4) Any bets “with a run” struck after the official announcement of the withdrawal of one or more horses/contestants shall not be subject to any deduction, unless there is a further withdrawal or withdrawals.

(5) Where a race is abandoned, all selections “with a run” on the race concerned shall become void.

(6) In starting price multiple bets “with a run”, winnings on winning bets shall be calculated and paid at the official starting prices, subject to the provisions of the starting price rule.

 

Postponed races

 Where a race advertised to be run on a certain date is postponed to any future date –

(1) All ante post bets on such race shall stand;

(2) Within 48 hours after the original advertised date at the same venue, all bets “with a run” shall stand;

(3) More than 48 hours after its initial scheduling, the race shall be deemed to have been abandoned for betting purposes, and bets “with a run” shall be treated as described in rule “Betting “with a run””

 

Change of venue or track

Where the venue of a race or track is changed from that originally advertised, the race shall be deemed to have been abandoned and such bets shall be treated as described in rule “Postponed races” mutatis mutandis.

 

Deductions

(1) Where a horse/contestant is withdrawn before or after coming under starter’s orders, all fixed odds bets on that horse/contestant shall be void, and all bets struck as fixed odds on the remaining horses/contestants on the day of the race or “with a run” shall be subject to deduction calculated in accordance with the following table –

(2) Any bets struck “with a run” after the official announcement of the withdrawal of one of or more horses/contestants shall not be subject to any adjustment unless there are further withdrawals.

(3) Should two horses/contestants be withdrawn simultaneously and both are subject to a deduction on any winning bets, the deduction s shall be applied separately and not simultaneously.

(4) Deductions shall not apply to starting price bets, unless a late withdrawal(s) occurs.

 

Starting prices and tote odds

(1) In starting price bets, the starting price shall be the last official fixed price disseminated either from the race track or recognized dissemination facility, as displayed on the betting board indicator at the start of the event.

(2) In the event of a late withdrawal where no new betting is displayed before the start of a race, the starting price shall be the last price displayed, subject to the adjustment reflected in the deduction table.

(3) Unless otherwise stipulated in the form of limits, any bet placed at tote odds shall be settled in accordance with tote dividends. The bookmaker can however pay more than the official tote dividend, subject to this being agreed to at the time the bet is struck.

(4) In starting price bets and open bets, any limits to actual dividends, odds and payouts which apply, shall be prominently displayed and be made available at all times by the bookmaker.

 

Open Bets

The following shall apply to “open bets”

(1) All open bets offered by a bookmaker shall be subject to limits as determined by the bookmaker if any;

(2) All local and international Horse racing tote dividends will be paid on the SAFTote Dividends, If SAFTote dividend is unavailable the dividend will be paid from the country of origins official tote dividend, with exception to Australia. If official SAFTote dividend is unavailable on Australian venues the Victorian Tote dividend will be used.   

 

Exotic Bets:  International Venues

All international venues will have Jackpot and Place Accumulator loaded ante post. For venues where local (South African) tote does not pay dividends for one or both of the above mentioned exotics, any bets taken on the affected exotics will be refunded.

 

Cover Bet 2 Places

The price for the selection to win the race is less than for Win markets, but money back if your selection finishes second. Bets on non-runners will be void, and when applicable deductions will apply to all remaining runners based on the price of the withdrawn horse in the normal Win market (not the Cover Bet price). In the event of non-runners the number of places paid will remain the same, unless the number of runners in the race is equal to or less than the number of places paid, in which case all bets will be void. Dead-heat rules apply. Best Odds Guaranteed does not apply to this market.

 

Cover Bet 3 Places 

As above but money back for finishing second or third.

 

Cover Bet 4 Places

As above but money back for finishing second, third or fourth. 

 

Place Only Betting

Fixed Odds Places

In a field of 3 runners or less no place bets will be accepted, all bets placed will null and void.

In the event of a dead heat in the places. Normal dead heat rules will apply.

In the event a scratching reduces a field to 3 runners or less all place bets will be refunded.

In the event that late scratchings reduced the number of runners and deductions are declared the bets will stand as taken subject to the relevant deductions in that race.

In the event of a scratching a deduction will be applied to the scratched horses price for all place bets.

 

Open Places

Tote rules will apply to open places only.

 

Betting Without

Dead-heat rules apply. Where we offer prices on an event without a nominated selection(s), for settlement purposes the finishing position of the ‘without’ selection(s) will be ignored.

In the event of a non-runner(s) a deduction will be applied based on the price (in the specified ‘without’ market) of the non-runner at the time of withdrawal. In the case of a non-runner(s) leaving only one quoted runner in a ‘without’ market, then bets will be void.

Where there are no finishers in a race, excluding the ‘without’ selections then all bets will be void.

 

Dead-Heats

Where two selections dead-heat half the stake money is lost and the full odds are paid to the other half. If more than two dead-heat the stake is proportioned accordingly.

 

Withdrawals Other Than Ante-Post

Where a horse is withdrawn before coming under starter's orders, or is officially deemed by the starter to have taken no part in the race, then stakes will be returned on the withdrawn horse and winning bets will be returned on the withdrawn horse and winning bets will be subject to deductions. The rate of deduction will be based on the price of the withdrawn horse at the time of its withdrawal.

 

Top Jockey/Trainer During a Season

Settlement will be based on the officially declared result.

 

Match Bets and Threesomes.

All horses must come under starter's orders or bets are void. The horse that attains the highest finishing position is the winner. Dead-heat rules apply. If both/all horses fail to finish all bets will be void and stakes returned. 

In the event of joint or co-favourites the lowest racecard number will be taken. If all races are not run bets will be void, unless settlement of bets is already determined. Our Double Result offer does not apply to this market.

All race bets are settled on the official classification from the Federation Internationale de l'Automobile (FIA), the sport's governing body, at the time of the podium presentation.

Drivers Championship
Each participant is priced to be the top driver over the Formula 1 season in accordance with Drivers Championship standings, and rules as specified by the FIA. Each-way terms apply.

Constructors Championship
Each participant is priced to be the top constructor over the Formula 1 season in accordance with Constructors Championship standings, and rules as specified by the FIA. Each-way terms apply.

Match Betting/Group Betting
Two drivers or constructors may be paired/put in a group for betting purposes and prices offered on which of them will finish in a higher position in the Drivers/Constructors Championship standings, as specified by the FIA, and in accordance with their official rules. Minimum 16 races must take place for bets to stand.

Individual Team Points/Team Handicap Matchups for Season/Team Season Specials
All bets are action regardless of driver changes. Minimum 16 races must be raced for bets to stand.

First Podium/Points/Win/Non-Podium Finish
Predict the first Grand Prix in which the specified driver will Finish on the Podium/Finish in the Points/Win a Race/Not have a Podium Finish. All races must take place in the specified order. Specified driver must take part in qualifying for bets to stand. Specified driver does not have to finish the race for bets to stand.

Most Race Wins/Pole Positions/Fastest Laps/Podium Finishes
Markets are settled based on results over the whole season. For settlement purposes official results from the FIA count, (including any result changes imposed by the FIA at the time of the podium presentation for the last race of the season). Dead-heat rules may apply.

Individual Driver Points/Driver Handicap Match-Up For Season/Driver Season Specials
For bets to stand each driver must take part in six races for the team he starts the season with. If driver switches team after more than six races then points/finishing placings accrued with new team will count in addition to those gained with original team. Minimum 16 races must take place for bets to stand.

Team/Driver Handicap Betting
All bets are action regardless of team changes. Minimum 16 races must take place for bets to stand.

Individual Grand Prix Betting
All drivers who start the formation lap are deemed as runners. The podium positions will be used to determine 1st, 2nd and 3rd for betting purposes.

Qualification Markets
Official qualifying times as recorded by the FIA will be used for settlement. For Fastest Qualifier, times recorded in the third phase count. If for some reason the third phase does not take place we will settle on the official grid as formed by the FIA. Grid position penalties do not apply for settlement purposes. However, qualifying time penalties (as specified by the FIA) will. Drivers must start the first phase of qualifying for bets to stand. For fastest in qualifying session 1 and 2, drivers must start the specified phase of qualifying for bets to stand.

Fastest in Practice Session One/Two/Three
Official lap times as recorded by the FIA will be used for settlement. Drivers must record a lap time in the specified phase of practice for bets to stand.

Fastest Driver in Every Qualifying Phase
Predict whether an individual driver will be the fastest qualifier in all 3 phases of qualifying.

Fastest Qualifying Stage
Predict which qualifying phase will produce the fastest qualifying time. Dead-heat rules apply.

To Reach Qualifying Session Three
Official qualifying times as recorded by the FIA will be used for settlement. Drivers must start the first phase of qualifying for bets to stand.

Start of the Race
The start of any race is defined as the signal to start the formation lap.

Number of Classified Drivers/Groups to Finish/To Finish Last/To Be Classified/Not to Finish the Race
Drivers that have completed 90% or more of the number of laps completed by the winner (rounded down to the nearest whole number of laps) are regarded as finishers in line with the official FIA classification at the time of the podium presentation.

Finish in the Points/Podium Finish
The result for settlement is at the time of the podium presentation. Subsequent disqualifications and/or appeals will not affect bets.

Highest Finishing Position
If both drivers fail to complete the race then the driver completing the most laps will be deemed the winner. If both drivers retire on the same lap then bets will be settled on the official classification at the time of podium presentation.

Finishing Position Markets
If both drivers fail to complete the race then the driver completing the most laps will be deemed the winner. If both drivers retire on the same lap then bets will be settled on the official classification at the time of podium presentation.

Next Retirement
Bets will be settled on the official FIA result. Dead-heat rules apply if two or more drivers retire on the same lap.

Team Points
Bets will be settled on the combined points total of both drivers within a manufacturer's team.

Race Match Betting
Bets will be settled on the official classification at the time of podium presentation.

Winning Car
All cars will be deemed as runners. The podium positions will be used to determine 1st, 2nd and 3rd for betting purposes.

Winning Margin/Qualifying Winning Margin
Bets will be settled on the official FIA result at the time of the podium presentation.

Fastest Lap
The official FIA result at the time of the podium presentation for the race will be used.

Dual Forecast
Both drivers must finish in the first two in the race. Any other finishing position or retirement then the bet is a loser. Based on the result at the time of the podium presentation. Subsequent disqualifications do not affect bets. If a driver is not in position to start the formation lap bets involving that driver are void.

Will There Be a Safety Car Period During the Race?
A Safety Car Period is defined as the need for the Safety Car to run in front of the leading car during a specified race. Should the race start under the Safety Car, then all bets concerning the Safety Car market will be settled as Yes. If the race finishes under Safety Car conditions but the safety car has not had time to get to the front of the leading car this market will be settled as Yes.

Race Group Betting
The winner is the driver achieving the highest placing at the time of the podium presentation. If all drivers in the group fail to be classified then the driver completing the most laps will be deemed the winner. If all drivers in the group fail to be classified and two or more drivers retired on the same lap then dead-heat rules apply. Drivers are grouped together for betting purposes only. Non-runner no-bet deductions in line with Rule 4 (Deductions) will apply. Bets will be settled on the official FIA result at the time of the podium presentation.

First Driver to Retire (Formation Lap Counts)
Driver must start 1st formation lap. Bet settlement will be determined by which lap number a car retires on. Should more than one car retire on the same lap then dead-heat rules apply.

Lap of First Retirement
A 2-Way (under/over) market will be offered for the lap in which the first race retirement takes place. Settlement will be based on official FIA results. (Note: The FIA display the number of completed laps a driver has achieved, so they would have retired on the next lap e.g. if the completed laps on the FIA result is 3 then the driver is deemed to have retired on lap 4 and this will be used for settlement purposes.) If no retirement takes place for a specified Grand Prix, bets will be settled as a Push.

First Constructor Retirement (Formation Lap Counts)
Bets will have action once the 1st formation lap starts. The winner is the constructor of the first car to retire. Should more than one car retire on the same lap then dead-heat rules apply.

Handicap Betting
Each driver's handicap is applied to their race time. The driver with the best race time after applying the handicap is considered the winner of this market. Race Leader must complete 40 laps for bets to stand. Bets stand irrespective of individual withdrawals. Any driver who does not finish the race or whose official classification is 1 lap or greater behind the winner will be deemed a loser. Dead-heat rules apply.

Race Best of Rest
Bets stand irrespective of individual withdrawals. Bets will be settled on the official FIA result at the time of the podium presentation.

First Race Win
All races must take place in the specified order otherwise bets are void. Specified driver must take part in qualifying for bets to stand.

First Lap Markets
Bets are settled on the first completed lap of the original race start. Any official restarts are disregarded, unless in the original race the first lap is not completed fully. In this case bets will be settled on the first fully completed lap.

Leader After 1 Lap
For settlement purposes the winner is deemed to be the driver leading the race as they cross the start/finish line after one classified race lap (formation lap not included). In the event of one lap not being fully completed all bets will be void.

To Retire on the 1st Lap
Any driver who is deemed to have completed no laps on the official FIA Race Classification will be deemed winners. If a driver is not in position to start the formation lap bets involving that driver are void.

Leader After Specified Laps
For settlement purposes the winner is deemed to be the driver leading the race as they cross the start/finish line after the specified race lap in accordance with the FIA's official Race Lap Chart. In the event of the specified number of laps not being fully completed all bets will be void.

Driver Position at End of 1st Lap
Select a driver's position at the end of the first fully completed lap of a named Grand Prix. Settlement will be based on the position recorded by the official FIA result. The named driver must start the race for bets to stand.

To Be Fastest in the Speed Trap
Official Speed Trap figures as recorded by the FIA on their Race Speed Trap document will be used for settlement. If a driver is not in position to start the formation lap bets involving that driver are void.

First/Last Driver to Make a Pit Stop
Official Pit Stop details as recorded by the FIA on their Race Pit Stop Summary will be used for settlement. If a driver is not in position to start the formation lap bets involving that driver are void.

To Get Caught Speeding in the Pit Lane
Settled on the decision of the FIA if they deem a driver has broken the pit lane speed limit during the race. If a driver is not in position to start the formation lap bets involving that driver are void.

To Finish the Race in a Better/Same/Worse Position than Grid Position
Settlement will be based on the driver's final position on the FIA's official classification at the time of the podium presentation and the driver's grid position at the start of the race. To receive a finishing position the driver must be a classified finisher in accordance with the FIA's rules. Any bet on a driver who is classed as retired on the official FIA classification and not given a finishing position is deemed a loser. Any driver not starting the race from their designated grid position, including from the pit lane, will be declared void.

Team Match-Ups
Settlement will be based on the team accumulating the most points at the end of a specified race

Constructor Handicap
The result will be determined by the number of points accumulated for a specified race by the two named constructors after the handicap has been applied.

Driver Handicap Matches
The result will be determined by the number of points accumulated for a specified race by the two named drivers after the handicap has been applied.

 

NASCAR/BUSCH RACING

Outright Race Betting
The Field includes any driver who is not listed. Any drivers who do not qualify for the race will be deemed no action. The race must be run within one week of the scheduled off time for there to be action. The official Nascar winner of the race shall be the winner of the race for wagering purposes (this includes all races which are halted prematurely for any reason).

Race Driver Match-Ups
All match-ups will be settled as per the official Nascar result. If one driver fails to complete the race then the other driver will be declared the winner. Where both drivers fail to complete the race then the number of full laps completed will determine the result. If both drivers fail to complete on the same lap then the official placing as assigned by the controlling authority will determine the result.

Both drivers must start the race (e.g. cross the start line) for bets to be action. If any driver is replaced before the start of the race then all match-ups will be void. For example, Driver Gordon qualifies in 1st place but due to injury is replaced by driver Brack (all bets void).

If a driver is replaced during the race then bets will stand on his replacement. For example, Driver Gordon starts the race but due to injury is replaced after 10 laps by replacement Driver Brack who then finishes the race and places 4th. In the race standings and for betting purposes Driver Gordon would be credited with a 4th place finish.

Race Props
Race props will be settled on official Nascar results. E.g. cautions, caution laps, lead changes, number of leaders, winning car etc. If a race is shortened and no official results are posted then all bets will be deemed no action.

For all markets, for customers ease, we will endeavour to grade all wagers at the conclusion of the race on the unofficial result. However we reserve the right to alter any wagers which may be affected by the official results as displayed on Nascar.com.

Qualifying
Qualifying match-ups are based on qualifying times (quickest times) and not the starting line up. For example, positions 37th to 43rd will be decided on times and not on any other criteria. If two or more drivers have an equal qualifying time then the driver with the higher grid position will be deemed the winner.

Bets will be void unless the driver starts the qualifying lap. If any driver fails to start then bets are deemed no action.

In the event of qualifying not being completed then all qualifying bets will be no action. All props will be settled on official Nascar results unless otherwise specified.

Future/Season Bets
All prop futures are deemed action when drivers qualify for at least 27 races. Outright Drivers Championship will be deemed as action when driver has qualified for at least 27 races.

 

MOTORBIKES

Championship Betting
All-in, compete or not. Bets will be determined by the number of points accumulated following the podium presentation of the final race of the season and will not be affected by any subsequent enquiries.

Individual Race Betting
Non-runner no-bet - Rule 4 (Deductions) may apply. All riders in place to start the warm-up lap are deemed as runners. The podium positions will be used to determine 1st 2nd and 3rd for betting purposes. Subsequent disqualifications and/or appeals will not affect bets.

Superbikes - Riders who are in place to start the warm-up lap in Race One are deemed as runners for Race Two as well. No betting deduction - Rule 4 (Deductions) - will be made on the remaining riders in Race two if there are any withdrawals following Race One.

Rider Finishing Position
Official race classification at the time of the podium presentation will be used for settlement. Subsequent disqualifications and/or appeals will not affect bets.

Rider Match Betting
Both quoted riders in a match, must be in place to start the warm-up lap of the specified Race, otherwise bets are void. If both riders fail to finish by going out on the same lap then bets will be void. Otherwise the rider completing most laps will be deemed the winner for settlement purposes.

Championship Groups/Match-Ups
Total number of points will decide the winner - following the podium presentation of the final race of the season. If the points are level then dead-heat rules will apply unless the Championship itself is tied. In this event the result will be determined by the competition rules. Any subsequent enquiries will not apply.

Pole Position
Official Qualification standings, as recorded by the governing body will be used for settlement purposes. Grid position penalties do not apply for settlement purposes. However, qualifying time penalties (as specified by the governing body) will.

Riders taking part in any of the official qualifying sessions (including free and qualification practice) are deemed to have taken part in the Pole Position market.

Pole Match Ups
Both riders must take part in a qualification session, after a bet has been placed, otherwise bets will be void.

First Lap Markets
Bets are settled on the first completed lap of the original race start, on a 'First Past the Post' basis, with any faulty start disregarded. Additionally, any official restarts are disregarded, unless in the original race the first lap is not completed fully. In this case bets will be settled on the first fully completed lap.

Winning Margin
Bets will be settled on the official result. World Superbikes refers to results listed on worldsbk.com, and Moto GP refers to results listed on motogp.com.

For example, a game is abandoned at 20-17: bets on Over/Under 37.5 Game - Total Points are settled as winners/losers respectively, since any natural conclusion to the game would have yielded at least 38 points.

Any match abandoned before the completion of 90 minutes play will be void except for those bets the outcome of which has already been determined at the time of abandonment. The market must be fully determined for bets to stand For example, first player to score or time of the first goal bets will stand provided a goal has been scored at the time of abandonment.

The only exception to the above abandoned match rule, is for all South American club matches where Full-Time Result and Double Chance markets (both pre-game and In-Play) will be settled on the score at the time of the abandonment providing the relevant league allows the result to stand.

Matches not Played as Listed
If a match venue is changed (other than to the away team's ground) then bets already placed will stand providing the home team is still designated as such. If the home and away team for a listed match are reversed (e.g. match is played at the original away team's ground) then bets placed based on the original listing will be void.

For matches played at a neutral venue (whether indicated on our site or not), bets will stand regardless of which team is listed as the home team.

Team First/Last Goalscorer

If a match is abandoned after the first goal is scored then all bets stand.

If a match is abandoned before the first goal is scored then all bets accepted for time bands that have been completed will be considered losing bets and any other time band which included the time band of the abandonment will be void and treated as non-runners.

Injury Time
Bets on the amount of injury time are settled on the time indicated by the fourth official’s board, rather than the actual time played.

10 Minute Events
Events must happen between 0:00 and 09:59 to be classed in the first 10 minutes (e.g. a corner awarded in this period but only taken after 10:00 will not count).

Time of First Corner
Bets are settled on what time the corner is actually taken (not the time it is awarded).

Half Time Scorecast (Half Time Correct Score and Player to Score First)
If a player enters the field after a goal has been scored; takes no part in the 1st half; or the only 1st half goals are own goals, then such bets will be settled as a single on the half time correct score market at the relevant odds quoted at match kick-off time.

Anytime Scorecast (Correct Score and Player to Score Anytime)
If player does not enter the field during 90 minutes or the only goals scored are own goals, then bets will be settled as singles on the correct score market at the relevant odds quoted at match kick-off time.

Wincast (Team to Win and Player to Score First)
If a player enters the field after a goal has been scored; takes no part in the game; or the only goals are own goals, then such bets will be settled as a single on the full time result market at the relevant odds quoted at match kick-off time.

Timecast (Time of First Goal and Player to Score First)

Players must start for bets to stand, otherwise bets involving that player will be void (regardless of when the first goal is scored). If the only goals scored are own goals, then bets will void.

Divisional Betting
For settlement purposes, in divisional betting the finishing position of teams at the end of the scheduled programme of matches will determine placing (dead-heat rules apply in the event of two or more teams tying in the standings (according to official competition rules)), and there will be no allowance for playoffs or subsequent enquiries by the respective leagues. Bets will stand on any team which does not complete all of its fixtures.

The only exception to this is for South American leagues, where a playoff is played to determine the league winner when teams are tied 1st on points. In this case, we will deem the league winner to be the winner of the subsequent playoff.

Top Goalscorer
Only goals scored within the quoted division are counted for this market irrespective of the team (within that division) for which they are scored. The team quoted alongside the player is for reference only. Only league goals count - excluding playoff matches. Own goals do not count. Dead-heat rules apply.

Season Match Bets/Team Points Totals
If any team does not complete all its fixtures then all match bets and team points total bets involving that team will be made void - win or lose.
